Justice ANTONY DOMINIC\n\n Dated :05\/01\/2009\n\n O R D E R\n                     ANTONY DOMINIC,J.\n                -----------------------\n                   W.P.(C).No. 37219\/2008\n               ------------------------\n            Dated this the 5th day of January, 2009.\n\n                          JUDGMENT\n<\/pre>\n<p>      Petitioner is working as a Commercial Tax Officer.<\/p>\n<p>According to the petitioner, she has given her salary<\/p>\n<p>certificate in order to enable one Abubacker to avail of<\/p>\n<p>chitty loan from the Kerala State Financial Enterprises.<\/p>\n<p>Petitioner submits that misusing this salary certificate, she<\/p>\n<p>had been shown as surety in four transactions between the<\/p>\n<p>four subscribers and the KSFE. According to the petitioner,<\/p>\n<p>the same has been done only with the connivance of the 3rd<\/p>\n<p>respondent.\n<\/p>\n<p>      2. Petitioner states that she came to know of this, only<\/p>\n<p>when the recovery proceedings were initiated by issuing<\/p>\n<p>Ext.P2. It is stated that there upon the petitioner has moved<\/p>\n<p>the 4th respondent by filing Ext.P3 complaint along with<\/p>\n<p>Ext.P4 stay petition. Her grievance is that orders have not<\/p>\n<p><span class=\"hidden_text\">WP(c).No.37219\/08                2<\/span><\/p>\n<p>been passed on Ext.P4 and that in the meanwhile recovery<\/p>\n<p>pursuant to Ext.P2 is being continued.\n<\/p>\n<p>      3. Although the petitioner is seeking a direction to the<\/p>\n<p>Lok Ayukta to consider Ext.P4 application to keep in abeyance<\/p>\n<p>further proceedings for recovery pursuant to Ext.P2, I do not<\/p>\n<p>think that the petitioner is justified in her prayer for keeping in<\/p>\n<p>abeyance Ext.P2. This is for the reason that, even according to<\/p>\n<p>the petitioner, she has agreed to be a surety in NCL 170\/08,<\/p>\n<p>for which according to her Ext.P1 confirmation of her salary<\/p>\n<p>certificate has been given. Therefore the respondents are, at<\/p>\n<p>any rate, entitled to recover from her salary, to liquidate the<\/p>\n<p>liability incurred towards NCL 170\/88.\n<\/p>\n<p>      In the aforesaid circumstances, particularly taking into<\/p>\n<p>account the complaint of the petitioner that she has not given<\/p>\n<p>her salary certificate for incurring liability in the remaining 3<\/p>\n<p>transactions, I direct that, for a period of 2 months, the<\/p>\n<p>amount recovered pursuant to Ext.P2 will be appropriated<\/p>\n<p>towards the petitioner&#8217;s liability in NCL 170\/08. In the<\/p>\n<p><span class=\"hidden_text\">WP(c).No.37219\/08               3<\/span><\/p>\n<p>meanwhile, it will be open to the petitioner to move the 4th<\/p>\n<p>respondent and         obtain appropriate interlocutory orders<\/p>\n<p>safeguarding her interest.
