While\t the  complaint\t was\npending before\ta Magistrate  the  parties  entered  into  a\ncompromise under which the appellants undertook to repay the\nloan before  a stipulated  date. The  Magistrate accordingly\nallowed the parties to compound the case.\n     When  the\tappellants  failed  to\trepay  the  loan  in\naccordance with\t the undertaking given before the Magistrate\nthe respondent\tmoved  the  High  Court\t for  taking  action\nagainst the  appellants for  contempt of  court. On the view\nthat the  appellants had committed a willful disobedience of\nthe undertaking the High Court held that they were guilty of\ncivil contempt\tand sentenced  them to\tone  month's  simple\nimprisonment.\n     Allowing the appeal in part,\n^\n     HELD:  1.\t The  appellants   had\t committed   willful\ndisobedience of\t the court  of the  Magistrate by committing\nserious breach\tof the\tundertaking given to it on the basis\nof which  alone they had been acquitted. The High Court was,\ntherefore, right  in holding that the appellants were guilty\nof civil  contempt under  s. 2(b)  of the Contempt of Courts\nAct. [638 A]\n     2. Having\tregard to  the circumstances of the case the\npresent case  falls within the first part of s. 12(3) of the\nAct and a sentence of fine alone should have been awarded by\nthe High  Court. By  enacting the  section  the\t legislature\nintended that  a sentence of fine alone should be imposed in\nnormal circumstances.  Special power  is, however, conferred\non the\tcourt to  pass a  sentence  of\timprisonment  if  it\nthought that  ends of justice so required. Therefore, before\na court\t passed a  sentence of\timprisonment  it  must\tgive\nspecial reasons for passing such a sentence. Shroff for the Respondents.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     FAZAL ALI,\t J.-This is  an appeal\tunder S.  19 of\t the<br \/>\nContempt of  Courts Act (hereinafter called the Act) against<br \/>\nan  order  of  the  High  Court\t of  Bombay  convicting\t the<br \/>\nappellants for\ta Civil\t Contempt and sentencing them to one<br \/>\nmonth&#8217;s simple imprisonment. The facts of the case have been<br \/>\nfully detailed by the High Court and it is not necessary for<br \/>\nus to  repeat the  same all  over  again.  It  appears\tthat<br \/>\nRespondent No.\t1 had  given a\tloan of\t Rs. 50,000\/- to the<br \/>\nappellants on certain conditions. Somehow or other, the loan<br \/>\ncould not  be paid  by the  appellants as  a result of which<br \/>\nRespondent No.\t1 filed\t a complaint  under  S.\t 420  I.P.C.<br \/>\nagainst the  appellants. While\tthe  complaint\twas  pending<br \/>\nbefore the Court of the Magistrate, the parties entered into<br \/>\na  compromise\ton  22-7-1971  under  which  the  appellants<br \/>\nundertook to  pay the  loan  of\t Rs.  50,000\/-\twith  simple<br \/>\ninterest  @  12%  per  annum  on  or  before  21-7-1972.  An<br \/>\napplication was\t filed before  the Court  for  allowing\t the<br \/>\nparties to  compound the  case and  acquit the\taccused. The<br \/>\nCourt  after  hearing  the  parties,  passed  the  following<br \/>\norder:-\n<\/p>\n<blockquote><p>\t  &#8220;The accused\tgiven an  undertaking to  the  court<br \/>\n     that he  shall repay  the sum  of Rs.  50,000\/- to\t the<br \/>\n     complainant on  or before\t21-7-1972 with\tinterest  as<br \/>\n     mentioned on the reverse. In view of the undertaking, I<br \/>\n     permit the compromise and acquit the accused&#8221;.<\/p><\/blockquote>\n<p>     It is  obvious, therefore, that the Court permitted the<br \/>\nparties to compound the case only because of the undertaking<br \/>\ngiven by the appellants.\n<\/p>\n<p>     Thereafter,  it   appears,\t that  the  undertaking\t was<br \/>\nviolated and  the  amount  of  loan  was  not  paid  to\t the<br \/>\nRespondent No.\t1 at  all. The\trespondent, therefore, moved<br \/>\nthe High  Court for  taking action  for\t contempt  of  Court<br \/>\nagainst the  appellants as  a result  of which\tthe  present<br \/>\nproceedings were  taken against them. The High Court came to<br \/>\nthe conclusion\tthat the  appellants had  committed a wilful<br \/>\ndisobedience of the undertaking given to the Court and were,<br \/>\ntherefore, guilty of civil contempt as defined in S. 2(b) of<br \/>\nthe Act. Hence, this appeal before us.\n<\/p>\n<p>     Mr. V.  S. Desai appearing in support of the appeal has<br \/>\nraised two  short points  before us.  He has  submitted that<br \/>\nthere is  no doubt  that the  appellants  had  violated\t the<br \/>\nundertaking but\t in the circumstances it cannot be said that<br \/>\nthe appellants\thad committed  a wilful\t disobedience of the<br \/>\norders of  the Court.  So far as this point is concerned, we<br \/>\nfully agree  with the  High Court. In the circumstances, the<br \/>\nappellants undoubtedly\tcommitted wilful disobedience of the<br \/>\norder of the court<br \/>\n<span class=\"hidden_text\">638<\/span><br \/>\nby committing  a serious  breach of the undertaking given to<br \/>\nthe Court  on the  basis of  which alone, the appellants had<br \/>\nbeen acquitted.\t For these reasons, the first contention put<br \/>\nforward by Mr. Desai, is overruled.\n<\/p>\n<p>     It is,  then, contended  that under  S. 12(3), normally<br \/>\nthe sentence  that should  be given  to an  offender who  is<br \/>\nfound  guilty\tof  civil   contempt,  is   fine   and\t not<br \/>\nimprisonment, which  should be given only where the Court is<br \/>\nsatisfied that\tends of\t justice require  the imposition  of<br \/>\nsuch a\tsentence. In our opinion, this contention of learned<br \/>\ncounsel for the appellants is well-founded and must prevail.<br \/>\nSub-section 3 of S. 12 reads thus :-\n<\/p>\n<blockquote><p>\t  &#8220;Notwithstanding  anything   contained   in\tthis<br \/>\n     section, where  a person  is found\t guilty of  a  civil<br \/>\n     contempt, the  Court, if  it considers that a fine will<br \/>\n     not meet  the ends\t of justice  and that  a sentence of<br \/>\n     imprisonment is  necessary shall, instead of sentencing<br \/>\n     him to  simple imprisonment, direct that he be detained<br \/>\n     in a  civil prison\t for such  period not  exceeding six<br \/>\n     months as it may think fit&#8221;.<\/p><\/blockquote>\n<p>     A close  and careful  interpretation of  the  extracted<br \/>\nsection leaves\tno  room  for  doubt  that  the\t Legislature<br \/>\nintended that  a sentence of fine alone should be imposed in<br \/>\nnormal circumstances.  The statute, however, confers special<br \/>\npower on  the Court to pass a sentence of imprisonment if it<br \/>\nthink that  ends of  justice so require. Thus before a Court<br \/>\npasses the  extreme sentence  of imprisonment,\tit must give<br \/>\nspecial reasons\t after a proper application of its mind that<br \/>\na  sentence  of\t imprisonment  alone  is  called  for  in  a<br \/>\nparticular situation  Thus, the\t sentence of imprisonment is<br \/>\nan exception while sentence of fine is the rule.\n<\/p>\n<p>     Having regard  to the  peculiar facts and circumstances<br \/>\nof this\t case, we  do not  find any  special reason  why the<br \/>\nappellants should  be sent  to jail  by sentencing  them  to<br \/>\nimprisonment.  Furthermore,   respondent  No.  1  before  us<br \/>\ndespite service,  has not  appeared to\tsupport the sentence<br \/>\ngiven  by   the\t High\tCourt.\tHaving\t regard\t  to   these<br \/>\ncircumstances, therefore,  we are satisfied that the present<br \/>\ncase, squarely\tfalls in  the first  part of  S. 12(3) and a<br \/>\nsentence of  fine alone\t should have  been given by the High<br \/>\nCourt. We,  therefore, allow this appeal to this extent that<br \/>\nthe sentence of imprisonment passed by the High Court is set<br \/>\naside and instead the appellants are sentenced to pay a fine<br \/>\nof Rs.\t1000\/- each.  In case  of default,  15\tdays  simple<br \/>\nimprisonment.
