\npetitioner is a  ~ Davanagere
\nZilia Panchayatv  forythse 2011. The
\nKarnataka__P\u00bba’ncti*a’vat~vii;aj_\u20acAct,  {hereinafter calied the
\n‘Act’), %%%%  of the local seif
\nGover{nmentsV’lli–‘ri,the  -‘Taluk and Zilla Panchayats.
\nSectionl\u00e91.7:_”Z’r’  with the election of the<\/p>\n
Adhrgaksha an’d._V_VtJbadViiyaksha of a Zilla Panchayat. The<\/p>\n
 oviifoftii\u00e9cevof the Adhyaksha of a Zilla Panchayat is a<\/p>\n
Al”p_e’ri_(‘)d and the term of the member of the<\/p>\n
Ziilla— Pa–.nct;~avat is a period of five years from the date of<\/p>\n
 hiseiection. The reservation of the post of Adhyaksha for<\/p>\n
  ‘p’e’rs*o:ns belonging to Scheduled Caste, Scheduled Tribe,<\/p>\n
 -backward ciass and women is on the basis of rotation in<\/p>\n
order to ensure that the members of all categories<\/p>\n

\nget eiected to the rlozt,f},fpr””–tyiieiV’Davanagere Zilla
\nPanchayat, the   in virtuai
\nmonopoiization\u00e9g  iast one decade’
\nPetitionervhasf:’pVr:3dv_c\u00e9d’  }showing the reservation
\nmade for._theV’i’po’sti:’ofy”Adiriyaksha in the Davanagere Ziiia
\nPanchayat\ufb02asVvipervirinegrorie ‘A’ to the writ petition.<\/p>\n
Acco\u00a7rd’ing to t’iie_VVpVetiti:oner, from 2000 to 2008, there has<\/p>\n
ybeeh reserva–tion in favour of ali categories except the<\/p>\n
 Accordingly, for the last decade, the<\/p>\n
mernberrs. ofithe Davanagere Zilla Panchayat belonging to<\/p>\n
.Vg:’thet__C5er1e.rai Category have not had an opportunity to be<\/p>\n
  eiecied to the post of Adhyaksha.\n<\/p>\n

\n2.3 It is further averred that the notification issued
\nby the first respondent dated 04.05.2009, which reserves
\nthe post of Adhyaksha for Backward Class members
\nviolates the spirit of the rotation policy that is envisaged<\/p>\n
under Section 177 of the Act and the action on the<\/p>\n
the first respondent in not providing any opportiuynity ”<\/p>\n
members beionging to the General\u00bb–.C\u00e9ate’gol_tv:’i*iis_ witFi\u00bb0i)t’ 0′<\/p>\n
authority of law and illegal l’actilon_ToT;_ <\/p>\n
respondent in reserving the for” the .p’a.ckw:ard “class”<\/p>\n
category when the said posts.—-hVad.aiready\ufb01’bveeniresen\/ed<\/p>\n
twice in the last four and violative of<\/p>\n
the rotation pVo’?ic’y._venvisaged’ under the Act and wherefore
\nthe Writ\u00e9Petiition”‘was’ fili\u00e9dseeking for the above referred

4. We have heard the learned counsel appearing<\/p>\n
for the appellant.\n<\/p>\n

submitted that the notification issued <\/p>\n

the said notification isvylwi–ap_lew to tie_  as the same is<\/p>\n
contrary to  of -‘Section 177 of the Act and
\nalso contraryto* the rota\u00e9tilon policy, which is meant to<\/p>\n
achi_eyeathe object ofireservation to persons belonging to<\/p>\n

7. The material on record would clearly show that<\/p>\n
there is no merit in the contention of the learned”rcfoun–s’el<\/p>\n
appearing for the Appellant that the post of  <\/p>\n
never been reserved for the ‘Gen__er.a,l__’4 catet_j’o’ry.’jVi\u00bbnlth\u00e9erylast V’<\/p>\n
10 years i.e., since 2000 till :’2AOGf9r~as<\/p>\n

  Learned counsel appearing for the appellant is unable to<\/p>\n
  -point out as to how the reservation made for the post of<\/p>\n
Adhyaksha in Davanagere Zilla Panchayat in favour of<\/p>\n
