SIRI JAGAN, J.\n              - - - - - - - - - - - - - - - - - - - - - - -\n                 W.P.(C)No. 17953 of 2010\n              - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 15th day of June, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioners are 2nd semester B.Sc students of the<\/p>\n<p>3rd respondent college. They were not permitted to appear<\/p>\n<p>for the 2nd semester examination for alleged shortage of<\/p>\n<p>attendance.  According to the petitioners, they were not<\/p>\n<p>intimated in time about the shortage of attendance and<\/p>\n<p>therefore they could not apply for condonation of shortage.<\/p>\n<p>Later on, when they contacted the authorities they came to<\/p>\n<p>understand that in fact there was no shortage of attendance<\/p>\n<p>as alleged. The examinations are over. They could not<\/p>\n<p>write the examination for the 2nd semester. As per the rules<\/p>\n<p>of the University, only a student who passes the<\/p>\n<p>2nd semester examination can write the 3rd semester<\/p>\n<p>examination. Petitioners now want to write the 3rd semester<\/p>\n<p>examination. Petitioners contend that in order to write the<\/p>\n<p>2nd semester examination again it is necessary to get orders<\/p>\n<p>W.P.(C)No. 17953 of 2010<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>regarding condonation of shortage of attendance for which<\/p>\n<p>the petitioners filed Exts.P3 &amp; P4 before the 2nd respondent.<\/p>\n<p>The petitioners seek a direction to the 2nd respondent to<\/p>\n<p>consider and pass orders on Exts.P3 &amp; P4 expeditiously and<\/p>\n<p>to direct the 3rd respondent to permit the petitioners to<\/p>\n<p>attend 3rd semester classes in the meanwhile.<\/p>\n<p>      2.    The standing counsel for the University opposes<\/p>\n<p>the same. He also points out that, the authority to consider<\/p>\n<p>the request for condonation of shortage of attendance is the<\/p>\n<p>Vice Chancellor.\n<\/p>\n<p>      3.    I have considered the rival contentions in detail.<\/p>\n<p>In the facts and circumstances of the case, I dispose of this<\/p>\n<p>writ petition with the following directions:<\/p>\n<blockquote><p>            The 2nd respondent shall place Exts.P3 &amp; P4<\/p>\n<p>      applications of the petitioners before the Vice<\/p>\n<p>      Chancellor of the University for his consideration<\/p>\n<p>      and disposal. The Vice Chancellor shall consider<\/p>\n<p>      and pass orders on Exts.P3 &amp; P4 as expeditiously<\/p>\n<p>      as possible, at any rate within a period of one<\/p>\n<p>W.P.(C)No. 17953 of 2010<br \/>\n<span class=\"hidden_text\">                             -3-<\/span><\/p>\n<p>      month from the date of receipt of a copy of this<\/p>\n<p>      judgment. Pending consideration of Exts.P3 &amp; P4<\/p>\n<p>      by the Vice Chancellor the petitioners shall be<\/p>\n<p>      permitted to attend classes for the 3rd semester.<\/p>\n<p>      However if ultimately they do not succeed their<\/p>\n<p>      attempt to get the shortage of attendance<\/p>\n<p>      condoned, they will not be eligible for any<\/p>\n<p>      concession in equity in respect of the period<\/p>\n<p>      during which they attended 3rd semester classes<\/p>\n<p>      and they will have to sit for the 2nd semester to<\/p>\n<p>      complete the full course and then attend the<\/p>\n<p>      3rd semester classes.<\/p><\/blockquote>\n<p>                                              S.
