Adeshra, learned advocate   waives the service of notice of<br \/>\n\tadmission on behalf of the respondent.\n<\/p>\n<p>Present<br \/>\n\tpetition  is filed by the  petitioner wife to amend Misc.Civil<br \/>\n\tApplication No.635 of 2007 for treating the said application under<br \/>\n\tsec.23(3) of the Code of Civil Procedure instead of under sec.24 of<br \/>\n\tthe Code of Civil Procedure.\n<\/p>\n<p>Mr.Adeshra,<br \/>\n\tlearned advocate appearing on behalf of the respondent has submitted<br \/>\n\tthat such an application would not be maintainable.\n<\/p>\n<p>Having<br \/>\n\t heard the learned advocate appearing on behalf of the  respective<br \/>\n\tparties and in the facts and circumstances of the case, without<br \/>\n\tprejudice to the rights and contentions of the respective parties<br \/>\n\twith respect to the maintainability of the application, present<br \/>\n\tpetition is allowed and the petitioner is permitted to amend<br \/>\n\tMisc.Civil Application NO.635 of 2007 and the said application be<br \/>\n\ttreated to have been filed under sec.23(3) of the Code of Civil<br \/>\n\tProcedure instead of under sec.24 of the Code of Civil Procedure.<br \/>\n\tNecessary amendment be carried out within a week from today. Rule is<br \/>\n\tmade absolute accordingly.
