Malkan, learned advocate appearing for the petitioners has<br \/>\n\tsubmitted that identical issue was involved in Special Civil<br \/>\n\tApplication No.4013 of 2010 and this Court disposed of the said<br \/>\n\tpetition on 01.04.2010 giving certain directions to the respondent<br \/>\n\tauthorities.  He has, therefore, submitted that the present<br \/>\n\tpetitions may be disposed of on the same line and same directions be<br \/>\n\tissued to the respondent authorities.\n<\/p>\n<p>In<br \/>\n\tthe present group of petitions, the petitioners have filed appeals<br \/>\n\tbefore the Divisional Railway Manager, Western Railway, Mumbai<br \/>\n\tchallenging the actions taken by the respondent authorities.<br \/>\n\tDespite the fact that considerable time has elapsed, no such appeals<br \/>\n\thave been decided by the respondent authorities.  He has, therefore,<br \/>\n\tsubmitted that appropriate direction may be issued to the<br \/>\n\trespondents to decide the second appeals filed by the petitioners.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate appearing for the petitioners and having gone<br \/>\n\tthrough the contentions of the petitioners as well as the<br \/>\n\tdocumentary evidence produced on record, the grievance of the<br \/>\n\tpetitioners is that the second appeals which are filed by the<br \/>\n\tpetitioners before the respondent No.4 authority are pending since<br \/>\n\tlong and these appeals are already ripe for hearing and the issue<br \/>\n\tbeing of recurring nature, the decision should have been taken by<br \/>\n\tthe respondent authorities as expeditiously as possible.\n<\/p>\n<p>In<br \/>\n\tthis view of the matter, the respondent No.4 is hereby directed to<br \/>\n\tdecide the second appeals preferred by the petitioners as<br \/>\n\texpeditiously as possible, preferably within a period of three<br \/>\n\tmonths from the date of receipt of certified copy of this order or<br \/>\n\twrit from this Court, whichever is earlier, after affording an<br \/>\n\topportunity of hearing.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid directions, all these petitions are disposed of.
