1.\tThis
\nis an application seeking modification\/deletion of condition Nos. 4,
\n5 and 7 imposed by this Court vide judgement and order dated
\n10.06.2011 passed in Criminal Misc. Application No. 6096 of 2011,
\nwhereby the accused-applicant was ordered to be released on bail in
\nconnection with F.I.R registered with Kamrej Police Station, Dist.
\nSurat, being C.R. No. I-78 of 2011 for offences punishable under
\nSections 420, 424, 467, 468, 471, 188, 120-B readwith Section 34 of
\nIPC.\n<\/p>\n
2.\tHeard
\nlearned advocate, Mr. Bharda, appearing for the accused-applicant and
\nMs. Krina Calla, appearing for the  State.\n<\/p>\n
3.\tVide
\norder dated 10.06.2011 passed by this Court, the accused-applicant
\nwas released on bail in connection with offences registered with
\nKamrej Police Station, Dist. Surat vide C.R.No. I-78 of 2011 on
\ncertain terms and conditions. Condition Nos. 4, 5 and 7, for which
\nthe present application has been preferred praying for
\nmodification\/deletion, reads as under:\n<\/p>\n
\t“4.\n<\/p>\n
\tnot leave the local limits of village old Koshamba,\tTal. Mangrol,
\nDist. Surat till conclusion of the trial;\n<\/p>\n
5.\tmark
\nhis presence once in a week on every Sunday at Kamrej Police Station
\nbetween 10.00 a.m. to 2.00 p.m. The applicant will leave village old
\nKoshamba only for the purpose of marking presence at Kamrej Police
\nStation;\n<\/p>\n
\t7.\tsurrender
\n\this passport, if any, to the Lower Court \timmediately.”\n<\/p>\n
4.\tLearned
\nadvocate appearing for the accused-applicant would submit that the
\naccused-applicant is a business man and is one of the active partners
\nof one Saleh Brothers Trading of Post Box 2087, Lenasia in
\nJohannesburg, South Africa, which was incorporated in the year 2006
\nbearing Registration No. 2006\/081954\/23 and registered with the
\nCompanies and Intellectual Property Registration Office, Registrar of
\nCompanies and Close Corporation, South Africa. He has annexed the
\ncertificate of registration. He would submit that the company owns a
\nsuper market and is also an importer and exporter of perfumes,
\ngroceries, spices and edible food items mostly rice. It is also
\nsubmitted that company has an import and export license issued by the
\nSouth African Revenue Service. It is submitted that one G.S.Akoojee &
\nAssociates, who are the accounting officers of the company, have,
\nvide letter dated 25.06.2011, informed the petitioner that it has
\nbeen receiving continues calls from South African Revenue Service in
\nrespect to the outstanding tax returns for company which, according
\nto the South African Revenue Service, are outstanding for two years,
\nand fourteen days has been given to submit the tax returns.\n<\/p>\n
5.\tIt
\nis submitted that, for this purpose, accused-applicant’s presence at
\nSouth Africa is necessary. Learned counsel would further submit that
\nif the Court is not inclined to permanently delete the conditions,
\nthen at least the three conditions may be suspended from its
\noperation for a period of three months to enable the
\naccused-applicant to visit South Africa and complete the necessary
\nwork regarding tax.\n<\/p>\n
6.\tLearned
\nAPP was directed to enquire with the concerned I.O. of the police
\nstation as regards the family background and the roots of the
\naccused-applicant in the society. Upon instructions of the concerned
\nI.O. of the police  station, it is informed that the
\naccused-applicant has immovable properties in India. He has a family
\nwho is residing at Village Mangrol.\n<\/p>\n
7.\tTaking
\ninto consideration the ground, as urged in this application,
\ncondition Nos. 4, 5 and 7, as imposed by this Court earlier, can be
\nordered to be suspended for a period of three months to enable the
\naccused-applicant to visit South Africa. Learned counsel informs that
\nthe         passport has been surrendered before the  Trial Court
\n  i.e. JMFC, Kathor, Tal. Kamrej, Dist. Surat. In the above view of
\nthe matter, following order is passed:\n<\/p>\n
(i)\tCondition
\nNos. 4, 5 and 7, imposed by this Court vide order dated 10.06.2011
\npassed in Criminal Misc. Application No. 6096 of 2011, shall remain
\nstayed from its operation upto 20.10.2011.\n<\/p>\n
(ii)\tLearned
\nJMFC, Kathor, is directed to handover the passport of the
\naccused-applicant. At the time of taking the passport, the
\naccused-applicant shall furnish the solvent surety of a sum of Rs. 1
\nlac before the Trial Court with an undertaking that the passport
\nshall be handed over immediately on his return from South Africa.\n<\/p>\n
(iii)\tAccused-applicant
\nshall handover the complete itinerary of his programme before the
\ninvestigating officer and the concerned police station before he
\nleaves the town of Koshamba and shall immediately inform about his
\nreturn to India. Rule is made absolute to the aforesaid extent.
