DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No.I &#8211; 151 OF 2010 with Dabhoda Police Station,<br \/>\n\tGandhinagar for the offences punishable under Sections 302, 506(2)<br \/>\n\tand 114 etc. of the Indian Penal Code and under Section 135 of the<br \/>\n\tBombay Police Act.\n<\/p>\n<p>Mr.Hemant<br \/>\n\tRaval, learned counsel appearing for the applicants submits that the<br \/>\n\tallegations against the applicants are to the extent that they had<br \/>\n\tlifted the deceased and thrown on the ground, while one Jayantibhai<br \/>\n\thad inflicted blow the wooden log on the head of deceased which<br \/>\n\tturned out to be fatal. It is submitted that the applicants are<br \/>\n\tfalsely implicated in the offence and considering the allegations in<br \/>\n\tthe context of the postmortem report, injuries caused and nature of<br \/>\n\tthe dispute, by imposing suitable conditions, the applicants may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>Mr.Kartik<br \/>\n\tPandya,  learned APP for the respondent &#8211; State has strongly<br \/>\n\topposed this application and submitted that the applicants  have<br \/>\n\tcommitted serious offences and they may not be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and considering the nature of offence and role attributed to<br \/>\n\tthe applicants and the allegations in the context of the postmortem<br \/>\n\treport, injuries caused and nature of the dispute, I am inclined to<br \/>\n\tenlarge the applicants on bail.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith First Information Report registered at C.R. No.I &#8211; 151 of<br \/>\n\t2010 with Dabhoda Police Station, Gandhinagar on executing bond of<br \/>\n\tRs.10,000\/- [Rupees Ten Thousand Only] each with one surety of the<br \/>\n\tlike amount to the satisfaction of the trial Court and subject to<br \/>\n\tthe conditions that they shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender their<br \/>\npassports, if any, to the lower Court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark their presence<br \/>\nat the concerned Police Station on the first Sunday of every month<br \/>\nbetween 10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddresses of residences to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicants only of they are not<br \/>\n\trequired in connection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extend.
