BASANT, J.\n\n              -------------------------------------------------\n\n                     CRL.M.C.NO.3267 OF  2006\n\n              -------------------------------------------------\n\n             Dated this the 3rd day of January, 2007\n\n\n                                 ORDER\n<\/pre>\n<p>      Against  the   petitioners  a   private  complaint  was  filed   by<\/p>\n<p>the   respondent\/complainant.     The   crux   of   the   allegations   is<\/p>\n<p>that   the   petitioners   made   false   representations   before   the<\/p>\n<p>complainant and induced him to accept a post dated cheque.<\/p>\n<p>They   had   no   serious   intention   to   honour   the   cheque.       They<\/p>\n<p>had   with   fraudulent   intention   induced   the   complainant   to<\/p>\n<p>receive the cheque.   Before the date fixed for presentation of<\/p>\n<p>the   cheque,   the   account   was   closed   by   the   petitioners   with<\/p>\n<p>fraudulent and objectionable motives.  On 20\/3\/2005 when the<\/p>\n<p>cheque   was   presented,   it   was   returned   dishonoured   on   the<\/p>\n<p>ground that the account is closed.  The private complaint filed<\/p>\n<p>by the complainant was referred by the learned Magistrate  to<\/p>\n<p>the police.   The police have registered a crime.   Investigation<\/p>\n<p>is   in   progress.     The   petitioners   have   now   come   before   this<\/p>\n<p>Court   with   the   prayer   that   the   powers   under   Sec.482   of   the<\/p>\n<p>Cr.P.C.   may   be   invoked   and   the   F.I.R.   registered   and   the<\/p>\n<p>investigation which has commenced may be quashed.<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO.3267 OF  2006  -: 2 :-<\/span><\/p>\n<p>      2.     The   learned   counsel   for   the   petitioners   submits   that<\/p>\n<p>there   was   no   fraudulent   intention   at   all   when   the   cheque   was<\/p>\n<p>handed over.   After  handing over of the cheque, the petitioners<\/p>\n<p>were   compelled   to   close   the   account   on   account   of   reasons<\/p>\n<p>beyond   their   control.     In   these   circumstances,   there   is   no<\/p>\n<p>element   of   culpability   and   no   ingredient   of   the   offence   of<\/p>\n<p>cheating   is   revealed,   it   is   contended.       The   petitioners   may   be<\/p>\n<p>saved   of   the   trauma   of   vexatious   criminal   proceedings   against<\/p>\n<p>them, it is prayed.\n<\/p>\n<\/p>\n<p>      3.     The   respondent\/the   de   facto   complainant   opposes   the<\/p>\n<p>application.     The   learned   counsel   submits   that   the   sequence   of<\/p>\n<p>events would clearly suggest that the petitioners, who closed the<\/p>\n<p>account without even intimating the complainant after the  date<\/p>\n<p>of   the   cheque,   were   acting   with   fraudulent   and   culpable<\/p>\n<p>intention.\n<\/p>\n<\/p>\n<p>      4.     It   is   too   early   for   this   Court   to   hazard   an   authentic<\/p>\n<p>opinion on the question whether the closing of the account was<\/p>\n<p>done   with   any   fraudulent,   contumacious   or   culpable   intention.<\/p>\n<p>Certainly, all  the  relevant facts will  have  to be  collected by the<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO.3267 OF  2006  -: 3 :-<\/span><\/p>\n<p>Investigator  in  the course  of investigation.   If at the time when<\/p>\n<p>the cheque was handed over, there was no fraudulent intention<\/p>\n<p>and  the  petitioners   were  obliged   on   account  of  reasons  beyond<\/p>\n<p>their   control   to   close   the   account,   no    criminal   offence   can   be<\/p>\n<p>alleged against the petitioners.   But whether culpable  intention<\/p>\n<p>was   there   or   not   at   the   time   when   the   post   dated   cheque   was<\/p>\n<p>handed   over   is   certainly   a   matter   which   will   have   to   be<\/p>\n<p>investigated and facts collected.   I find absolutely no reason, at<\/p>\n<p>this stage, to prematurely terminate the investigation against the<\/p>\n<p>petitioners.\n<\/p>\n<\/p>\n<p>      5.     I   find   no   merit   in   the   contention   that   the   failure   or<\/p>\n<p>miscarriage   of   justice   would   result.       The   petitioners   can<\/p>\n<p>certainly appear before the learned Magistrate and seek bail.  In<\/p>\n<p>the alternative, they can approach the superior courts for grant<\/p>\n<p>of anticipatory bail, if sufficient circumstances exists.   The mere<\/p>\n<p>possibility of arrest and continuation of the investigation cannot,<\/p>\n<p>in   the   facts   and   circumstances   of   this   case,   be   reckoned   as<\/p>\n<p>amounting   to   failure   or   miscarriage   of   justice   to   justify   the<\/p>\n<p>invocation of the powers under Sec.482 of the Cr.P.C.<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO.3267 OF  2006  -: 4 :-<\/span><\/p>\n<p>        6.   This Crl.M.C. is, in these circumstances, dismissed with<\/p>\n<p>the above observations.\n<\/p>\n<\/p>\n<p>                                                         Sd\/-\n<\/p>\n<p>\n                                                 (R.
