It is also submitted by<br \/>\nhim that in this matter chargesheet is also filed and now question<br \/>\ndoes not arise for tampering with the evidence and therefore it is<br \/>\nrequested to  delete the condition imposed by the learned Presiding<br \/>\nOfficer and Additional Sessions Judge, Fast Track Court No.1,<br \/>\nBhavnagar vide impugned order dated 6.1.2010 passed below Exh.1 in<br \/>\nCriminal Misc. Application No.623 of 2009 whereby the petitioner is<br \/>\nrestrained to enter into the local limits of Bhavnagar District till<br \/>\nthe trial is over.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Bhargav Bhatt appearing on behalf of the respondent No.2\n<\/p>\n<p>&#8211;  has opposed the same and submitted that the present petitioner is<br \/>\na head-strong person, and if the said condition is deleted then there<br \/>\nis likelihood of tampering with the evidence as well as daily affairs<br \/>\nof Amargadh (Jithri) Hospital as present petitioner is a union leader<br \/>\nand a head-strong person.\n<\/p>\n<p>5.\tThis<br \/>\nCourt has gone through the impugned order passed by the trial court.<br \/>\nIt is an admitted fact that there is no breach of condition as far as<br \/>\nbail order and nothing is adversely reported against present<br \/>\npetitioner and chargesheet is also filed.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the condition   imposed by<br \/>\nthe learned Presiding Officer and Additional Sessions Judge, Fast<br \/>\nTrack Court No.1, Bhavnagar vide impugned order dated 6.1.2010 passed<br \/>\nbelow Exh.1 in Criminal Misc. Application No.623 of 2009 whereby the<br \/>\npetitioner is restrained to enter into the local limits of Bhavnagar<br \/>\nDistrict till the trial is over is modified to the effect that the<br \/>\npetitioner is entitled to enter into the local limits of Amargadh,<br \/>\nDistrict Bhavnagar with a condition that he shall mark his presence<br \/>\nbefore Songadh Police Station  on 1st and 15th<br \/>\nof every English Calendar Month till the trial is over.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute to the aforesaid extent.
