(Oral )<\/p>\n<p>            The petitioner is widow of the deceased employee, who was<\/p>\n<p>working as Sweeper in Municipal Council, Fazilka and died on 8.6.2008.<\/p>\n<p>After his death, the petitioner is entitled for his service benefits, like<\/p>\n<p>pension, gratuity and leave encashment etc. It is the case of the petitioner<\/p>\n<p>that after the death of her husband, only an amount of Rs. 1 lac being the ex-<\/p>\n<p>gratia grant has been paid to her, but the other service benefits have not<\/p>\n<p>been released to her. In this regard, she served a legal notice dated<\/p>\n<p>23.1.2009 upon respondent No.3, copy of which has been annexed with the<\/p>\n<p>petition as Annexure P-2. It is the case of the petitioner that neither the<\/p>\n<p>aforesaid legal notice has been considered and decided so far nor the service<\/p>\n<p>benefits of her deceased husband have been released to her. Counsel states<br \/>\n<span class=\"hidden_text\"> CWP No. 14196 of 2009                                                   -2-<\/span><\/p>\n<p>that at this stage, the petitioner will be satisfied if a direction is issued to<\/p>\n<p>respondent No.3 to consider and decide the aforesaid legal notice in<\/p>\n<p>accordance with law, within a reasonable time.\n<\/p>\n<p>             In view of the above, without issuing notice of motion as it will<\/p>\n<p>un-necessary delay the matter, this petition is disposed of with a direction to<\/p>\n<p>respondent No.3 to consider and decide the legal notice dated 23.1.2009<\/p>\n<p>(Annexure P-2) in accordance with law, expeditiously, preferably within a<\/p>\n<p>period of three months.
