The petitioners before the learned<br \/>\n\tSingle Judge were Junior Engineers working with Western Region of<br \/>\n\tONGC. One Mr. R.N. Patel was transferred from Bombay region to<br \/>\n\twestern region. According to the policy of the appellants said Mr.<br \/>\n\tPatel was to rank junior to all those who were already working in<br \/>\n\tthe western region. This juniority was in relation to general<br \/>\n\tseniority list.\n<\/p>\n<p>Learned<br \/>\n\tcounsel has submitted that a policy came to be made by the<br \/>\n\tappellants ONGC  that those who have completed one year term in the<br \/>\n\tscale of Rs.725-1480 as on 31\/12\/1985  was required to be considered<br \/>\n\tfor promotion in the pay scale of Rs.1030-2000 and in that list what<br \/>\n\thappened was present respondents\/petitioners were not qualified in<br \/>\n\tthe one year policy.  However one Mr. R.N. Patel having worked in<br \/>\n\tthe said pay scale  after one year completion, but in two different<br \/>\n\tregions, has been  considered for promotion by ONGC. Learned Single<br \/>\n\tJudge considered the case of the petitioners with the case of said<br \/>\n\tMr. Patel and opined that though Mr. Patel has not worked in western<br \/>\n\tregion  for one year and according to the policy of one year working<br \/>\n\tin pay scale of Rs.725-1480 in a region, and all those who are<br \/>\n\tranked seniority to said Mr. Patel were required to be considered<br \/>\n\tfor promotion.  Learned counsel for the appellant has not been able<br \/>\n\tto refute this position that all the persons working in pay scale of<br \/>\n\tRs.725-1480  has to complete one year in the same pay scale. Though<br \/>\n\tin the present case said Mr. Patel ranks below the seniority of the<br \/>\n\tpetitioners in western region, they were denied the benefit of<br \/>\n\tpromotion only on the ground  that Shri Patel was appointed earlier<br \/>\n\tin point of time. Therefore Learned Single Judge has been pleased to<br \/>\n\tissue direction that the petitioners be considered to be eligible<br \/>\n\tfor consideration under the one year policy and give them pay scale<br \/>\n\tof Rs.1030-2000.\n<\/p>\n<p>We<br \/>\n\thave perused the order passed by  learned Single Judge and relevant<br \/>\n\tdocuments \/ papers produced on record. Heard learned counsel for the<br \/>\n\tparties.  The service of Mr. Patel as Junior Engineer in the pay<br \/>\n\tscale of Rs. 725-1480 was for one year but in two different regions,<br \/>\n\tand not in western region. Therefore giving benefit to Mr. Patel for<br \/>\n\tthe work rendered in another region would not entitle Mr. Patel to<br \/>\n\tget the advantage of one year policy. This is only a fallacious<br \/>\n\tproposition that the appellants have created just to give promotion<br \/>\n\tto Mr. Patel. In that view of the matter learned Single Judge has<br \/>\n\tordered that the petitioners are eligible to get promotion who are<br \/>\n\tseniors to Mr. Patel in the western region.\n<\/p>\n<p>In<br \/>\n\tsupport of contention of the appellants learned counsel has cited a<br \/>\n\tdecision of Hon&#8217;ble Supreme court reported in (2010) 4 SCC 301, in<br \/>\n\tcase of  H.S. VANKANI AND OTHERS Vs. STATE OF GUJARAT &amp; ORS.<br \/>\n\tHowever we do not see any rational in one year policy announced by<br \/>\n\tthe appellants. This policy sounds us to be discriminatory qua those<br \/>\n\tpetitioners because they were working in the western region alone<br \/>\n\thave not been considered and in case of Mr. Patel, though he worked<br \/>\n\tin two different regions, has considered for the benefit of one year<br \/>\n\tpolicy. That a particularly employee gets the advantage of one year<br \/>\n\tserving in same line but worked in two different regions has been<br \/>\n\tbenefited of the policy created by the appellants, but the persons<br \/>\n\tworked in the same region is not given advantage of that policy.\n<\/p>\n<p>It<br \/>\n\tmay be mentioned here that learned counsel has argued much  in<br \/>\n\trelation to the policy of one year and we notice from the order of<br \/>\n\tlearned Single Judge that engineers in  mechanical branch  of the<br \/>\n\tappellants though  have not completed one year service as on<br \/>\n\t1\/1\/1986 were given the benefit of one year policy, as the engineers<br \/>\n\twho are  juniors  as they  have come from other regions after having<br \/>\n\tworked for more than one year service have been given the benefit.<br \/>\n\tIn the case of the petitioners the service conditions are not<br \/>\n\tdistinguishable with the case of engineers of mechanical branch  of<br \/>\n\tthe appellants.  Learned Single Judge has elaborately discussed this<br \/>\n\tpoint in its order. We find that appellants have been creating<br \/>\n\tpolicies for treating different employees at different levels. In<br \/>\n\tthat view of the matter we  do not see any interference is called<br \/>\n\tfor in the orders passed by learned Single Judge.\n<\/p>\n<p>Learned<br \/>\n\tcounsel has further submitted that it would not be fair for this<br \/>\n\tCourt to unsettle the seniority list which have come to be settled.<br \/>\n\tWe may say that the appellants have flouted the order of learned<br \/>\n\tSingle Judge for all these years and having flouted the orders of<br \/>\n\tthis Court, it does not lie in the mouth of the counsel for the<br \/>\n\tappellants to say that by the orders of this Court the character of<br \/>\n\tseniority has been changed. Therefore this argument has also no<br \/>\n\tbase. For the reasons recorded herein above, we find no merits in<br \/>\n\tthe appeals. No interference is called for in the orders passed by<br \/>\n\tlearned Single Judge.
