1.\tHeard
\nMr. B.C. Dave, learned advocate for the applicant and Mr.Desai,
\nlearned APP for the respondent-State.\n<\/p>\n
2.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Limbayat
\nPolice Station,
\nSurat bearing
\nC.R. No.I-80
\nof 2011 for
\nthe offence punishable under Sections 454, 380 and 114 of Indian
\nPenal Code.\n<\/p>\n
3.\tMr.Dave,
\nleaned advocate for the applicant has submitted that FIR does not
\nreveal the name of present applicant. He further submitted that now
\nthe chargesheet is filed and that therefore there is no likelihood of
\ntampering with the evidence. He also submitted that there is no nexus
\nwith the present incident of the applicant. He further submitted that
\nthe alleged offence against the applicant is Magistrate triable.\n<\/p>\n
4.\tThe
\napplication is opposed by Mr.Desai, learned APP, who has submitted
\nthat the applicant had committed the alleged offence which is serious
\nin nature, there has been recovery of stolen material from the
\napplicant and that therefore the application deserves to be rejected.\n<\/p>\n
5.\tHaving heard
\nthe learned counsel for both the sides and considering the facts and
\ncircumstances of the case as well as the documents and other material
\nproduced on record of this case, the gravity of the offence, the
\nquantum of punishment, the allegations against the applicant, the
\nmanner in which the applicant is allegedly involved in the case as
\nper the allegation of the prosecution, coupled with the fact that
\nprima facie it appears that FIR does not reveal
\nthe name of present applicant and \/ or about the alleged modus
\noperandi, now the chargesheet is filed, I am of the view that the
\napplicant deserve to be released on bail. Furthermore, the alleged
\noffence against the applicant is Magistrate triable offence and in
\nthe complaint there is no specific allegation about the alleged modus
\noperandi of the present applicant of engaging young children to carry
\nout the illegal and unlawful activities and it appears to be
\nallegation by co-accused, I am inclined to allow this
\napplication and release the applicant on appropriate condition.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicant  in connection with CR
\nNo.I-80 of 2011 registered
\nwith Limbayat
\nPolice Station,
\nSurat be released on bail, in respect of the offences alleged against
\nhim in this application, on his executing and furnishing a bond of
\nRs.15,000\/- (Rupees: Fifteen Thousand Only) with two solvent sureties
\nof like amount, by the concerned Police Officer, and on condition
\nthat he shall:-\n<\/p>\n
\t(a) not take
\nundue advantage of or abuse the \tliberty.\n<\/p>\n
(b) not act in
\nmanner injurious to the interest of the prosecution.\n<\/p>\n
(c) maintain
\nlaw and order.\n<\/p>\n
(d) not leave
\nthe State of Gujarat without prior permission of the Sessions Court
\nconcerned.\n<\/p>\n
(e) furnish the
\naddress of his residence at the time of execution of bond and shall
\nnot change the residence without prior permission of the Sessions
\nCourt\/this Court.\n<\/p>\n
(f) surrender
\nhis passport, if any, to the lower court within 4 days from the date
\nof this order.\n<\/p>\n
(g)
\nmark his presence at the Limbayat
\nPolice Station, Surat initially
\non 14.10.2011
\nand
\nthereafter on every first and fifteenth day of every month,
\nbetween
\n11.00 a.m. to
\n3.00 p.m.<\/p>\n
(h) not enter
\nthe revenue limit of village Limbayat as well as Surat District till
\nthe trial is over without prior permission of the Sessions Court, but
\nfor marking his presence and attending the Court in connection with
\nthis case the applicant will be free to enter the limits for a period
\nto the extent necessary and will leave the limits of Surat District
\nimmediately after the case is adjourned.\n<\/p>\n
7.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
8.\tIf breach of
\nany of the above conditions is committed the Sessions Judge concerned
\nwill be free to issue warrant or take any appropriate action in the
\nmatter.\n<\/p>\n
9.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.\tAt the
\ntrial, the trial Court shall not be influenced by the observations,
\nwhich are purely prima facie, tentative and preliminary nature and
\nhave been made only for the purpose of examining prayer for bail
\npending the trial. The Court shall arrive at its own conclusion
\nindependently on the basis of the evidence and other aspects of the
\ncase.\n<\/p>\n
11.\tRule is
\nmade absolute to the aforesaid extent. Direct service is permitted.\n<\/p>\n
