Poojari waives service of notice of rule on<br \/>\nbehalf of the respondent-State.\n<\/p>\n<p>\tThe<br \/>\npresent application has been filed for extension of time to surrender<br \/>\nbefore the Jail Authority on the grounds stated in the memo of<br \/>\napplication.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel, Mr.Jayraj Chauhan for Mr.M.M. Desai for the<br \/>\napplicant-appellant.\n<\/p>\n<p>\tLearned<br \/>\ncounsel, Mr.Chauhan has submitted that though the matter was<br \/>\nadjourned, Mr.Desai could not remain present as he was not well and<br \/>\nwas having problem for kidney stone. He has also stated that he looks<br \/>\nafter his work and he is assigned some matters but not the present<br \/>\nmatter. He has, therefore, requested for extension of time to<br \/>\nsurrender pursuant to oral judgment passed in Criminal Appeal<br \/>\nNo.1321\/1993 dated 21.06.2010. Learned counsel, Mr.Chauhan has also<br \/>\nstated that the applicant-appellant is also desirous to approach the<br \/>\nHon&#8217;ble Apex Court and time may be extended.\n<\/p>\n<p>\tThough<br \/>\nthe submissions have been made, they are thoroughly misconceived. On<br \/>\none hand, the complaints are being made about the matters are not<br \/>\nbeing taken up and on the other hand, the advocates do not remain<br \/>\npresent like in the present case. Learned counsel, Mr.Desai was not<br \/>\npresent and the Court had repeatedly adjourned the matter and,<br \/>\nthereafter, he was not traceable even after communication or trying<br \/>\nto secure his presence and, hence, the Court was left with no<br \/>\nobjection but to proceed further with the matter.\n<\/p>\n<p>\tEven<br \/>\nif the learned counsel, Mr.Desai was not present for personal reasons<br \/>\nor for medical ground, he could have deputed some advocate friend<br \/>\nat-least to inform the Court and should have shown courtesy and,<br \/>\ntherefore, no indulgence can be granted once the order has been<br \/>\npronounced and only to seek extension of time, indulgence is sought<br \/>\nfor on the ground that the applicant-appellant is desirous to<br \/>\napproach the Apex Court. It is required to be mentioned that though<br \/>\nit is stated by the learned counsel Mr.Chauhan that Mr.Desai was not<br \/>\nwell, no medical certificate or any case paper is produced on record.<br \/>\nFurther, when the learned counsel, Mr.Chauhan, who is appearing<br \/>\ntoday, has conveniently stated that he is assigned some of the<br \/>\nmatters and when he is working with the some matters for Mr.Desai,<br \/>\nat-least courtesy should have been shown after looking at the board<br \/>\nthat this matter is repeatedly adjourned. Therefore, the indulgence<br \/>\ncannot be shown in such matter, particularly, after such an attitude.<br \/>\nNormally, the Court would grant some time to enable the litigant to<br \/>\napproach the Apex Court. However, in the facts of the present case,<br \/>\nparticularly, since it is criminal appeal, one has to surrender<br \/>\nfirst. Therefore, even on that count, the request cannot be<br \/>\nentertained.
