S.J. MUKHOPADHAYA)<\/p>\n<p>\tApart<br \/>\nfrom the  fact that the writ petition  alleging  fraud against   a<br \/>\nprivate bank was not maintainable, we find that  when the bank (HDFC<br \/>\nBank) issued  notice of  Seventh  Annual General Meeting informed<br \/>\nthat the Bank had reserved all its right to proceed against  the<br \/>\nappellant Mr.S.B.Parekh,  it is only thereafter the appellant has<br \/>\nalleged fraud against the Bank.\n<\/p>\n<p>\tFurther,<br \/>\nafter hearing the appellant in person, when the learned Judge  was<br \/>\ndictating the order, the appellant filed an application  for<br \/>\nwithdrawal of the case.  For the above reasons, we are not inclined<br \/>\nto entertain these appeals.
