QUDDUSI, J <\/p>\n<p>1.   Heard counsel for the parties at length.\n<\/p>\n<p>2.   This  Writ  Appeal  has been  filed  against  the<br \/>\n     impugned  order dated 28\/02\/09 passed by  learned<br \/>\n     Single Judge in Writ Petition (S) No. 59\/08.\n<\/p>\n<p>3.   It  is  alleged in the writ appeal that the  writ<br \/>\n     appellants  were selected by the  Public  Service<br \/>\n     Commission  in a selection process  conducted  in<br \/>\n     the  year 2006 for the post of Assistant District<br \/>\n     Public    Prosecution   Officer   (ADPPO)    vide<br \/>\n     advertisement  dated  21\/09\/06,  issued  by   the<br \/>\n     Chhattisgarh  Lok Seva Ayog, in which  the  total<br \/>\n     number   of  posts  advertised  was  32  with   a<br \/>\n     condition that the number of vacancies may  vary.<br \/>\n     Secondly  their  names were found  place  in  the<br \/>\n     merit  list, but they were not given appointments<br \/>\n     and the District Magistrates were directed by the<br \/>\n     State   Government  to  make  appointment   under<br \/>\n     section  25  of  the Cr.P.C. on  contract  basis.<br \/>\n     Thereafter,  the  District Magistrate  advertised<br \/>\n     the vacancies for making contractual appointments<br \/>\n     on  12\/14.12.07 for a period of one year. It  has<br \/>\n     been mentioned that the post of ADPPO is a Class-<br \/>\n     II Gazetted post and is within the purview of the<br \/>\n     Public Service Commission, therefore in the  year<br \/>\n     2006, the Public Service Commission, after making<br \/>\n     selection,  made  recommendations  to  the  State<br \/>\n     Government   submitting   merit   list   of   105<br \/>\n     candidates   in   respect  of   all   categories,<br \/>\n     including reserved category candidates.\n<\/p>\n<p>4.   The  learned Single Judge has in his judgment and<br \/>\n     order observed that the State Government alone is<br \/>\n     competent   to   appoint  the  Assistant   Public<br \/>\n     Prosecutors  or  ADPPOs. However,  in  accordance<br \/>\n     with  the above quoted provisions, in a situation<br \/>\n     where no APP is available for the purpose of  any<br \/>\n     particular  case,  the  District  Magistrate  may<br \/>\n     appoint any other person to be the APP in  charge<br \/>\n     of  that  case  alone.  The  District  Magistrate<br \/>\n     cannot   appoint  the  ADPPOs,  in  general,   on<br \/>\n     contract  basis  under  section  25  of   Cr.P.C.<br \/>\n     However,  the  learned Single Judge has  directed<br \/>\n     that  the  contract appointees may continue  till<br \/>\n     regular   appointment  is  made  through   proper<br \/>\n     selection  by  the Public Service  Commission  or<br \/>\n     term of extension of the candidates appointed  on<br \/>\n     contract basis is over, whichever is earlier.\n<\/p>\n<p>5.   Before  proceeding further, it  is  necessary  to<br \/>\n     peruse  the  provisions of section 25 of  Cr.P.C.<br \/>\n     which are quoted as under:\n<\/p>\n<blockquote><p>               &#8220;25.  Assistant  Public Prosecutors-(1)<br \/>\n               The  State Government shall appoint  in<br \/>\n               every  district  one or more  Assistant<br \/>\n               Public   Prosecutors   for   conducting<br \/>\n               prosecutions   in   the    Courts    of<br \/>\n               Magistrates.\n<\/p><\/blockquote>\n<blockquote><p>               (1-A)   The   Central  Government   may<br \/>\n               appoint  one  or more Assistant  Public<br \/>\n               Prosecutors   for   the   purpose    of<br \/>\n               conducting any case or class  of  cases<br \/>\n               in the Courts of Magistrates.\n<\/p><\/blockquote>\n<blockquote><p>               (2)  Save as otherwise provided in sub-<br \/>\n               section (3), no police officer shall be<br \/>\n               eligible   to   be  appointed   as   an<br \/>\n               Assistant Public Prosecutor.\n<\/p><\/blockquote>\n<blockquote><p>               (3)    Where   no   Assistant    Public<br \/>\n               Prosecutor   is   available   for   the<br \/>\n               purposes  of any particular  case,  the<br \/>\n               District  Magistrate  may  appoint  any<br \/>\n               other person to be the Assistant Public<br \/>\n               Prosecutor in charge of that case:\n<\/p><\/blockquote>\n<blockquote><p>                    Provided  that  a  police  officer<br \/>\n               shall not be so appointed-\n<\/p><\/blockquote>\n<blockquote><p>               (a)  if  he  has taken any part in  the<br \/>\n                    investigation  into  the   offence<br \/>\n                    with  respect to which the accused<br \/>\n                    is being prosecuted, or<\/p>\n<\/blockquote>\n<blockquote><p>               (b)   if  he  is  below  the  rank   of<br \/>\n          Inspector.\n<\/p><\/blockquote>\n<p>6.   A  perusal  of  the  above quoted  provisions  of<br \/>\n     section   25(3)  Cr.P.C.  would  show  that   the<br \/>\n     District  Magistrate  has been  given  powers  to<br \/>\n     appoint   a   person   to  be  Assistant   Public<br \/>\n     Prosecutor  in  charge  of  that  case   with   a<br \/>\n     condition   that   where  no   Assistant   Public<br \/>\n     Prosecutor  is available for the purpose  of  any<br \/>\n     particular  case.  The expression of  words  &#8220;any<br \/>\n     other person&#8221; shows that if a person in charge of<br \/>\n     a  particular case is not available, only in that<br \/>\n     case  any other person be appointed to be  Public<br \/>\n     Prosecutor   in   charge  of  that   case.    The<br \/>\n     Legislature has taken care of writing  the  words<br \/>\n     &#8220;any   other  person&#8221;  and  as  such   there   is<br \/>\n     difference between the phrases &#8220;any other person&#8221;<br \/>\n     and  &#8220;a  person&#8221;.  The phrase &#8220;any other  person&#8221;<br \/>\n     denotes the substitute of a person and as such if<br \/>\n     any   person   appointed  as   Assistant   Public<br \/>\n     Prosecutor  to  conduct a case is not  available,<br \/>\n     only   in   that   circumstance,   the   District<br \/>\n     Magistrate  can appoint any other person  in  his<br \/>\n     place  to  act as Assistant Public Prosecutor  in<br \/>\n     charge of that case.\n<\/p>\n<p>7.   Therefore, a plain reading of section 25  Cr.P.C.\n<\/p>\n<p>     shows that the State Government in every District<br \/>\n     of  the  State  and the Central  Government,  are<br \/>\n     empowered  to make appointments of  one  or  more<br \/>\n     Assistant  Public Prosecutors  as  a  whole.  The<br \/>\n     difference  in appointment by the State  and  the<br \/>\n     Central  Government is that the State  Government<br \/>\n     to  appoint in each district of the State one  or<br \/>\n     more  Assistant Public Prosecutors for conducting<br \/>\n     the prosecution in the courts of Magistrates, but<br \/>\n     it   is   not  the  obligation  of  the   central<br \/>\n     Government   to  appoint  one  or   more   public<br \/>\n     prosecutors in each district and also the central<br \/>\n     Government  may  appoint  the  Assistant   Public<br \/>\n     Prosecutor to conduct any case or class of  cases<br \/>\n     in the Courts of Magistrates.  The above power of<br \/>\n     the  State Government cannot be exercised by  the<br \/>\n     District  Magistrate  under  sub-section  (3)  of<br \/>\n     section  25.  Therefore, the District  Magistrate<br \/>\n     can exercise powers which are to be exercised  in<br \/>\n     emergent   cases   where  the  Assistant   Public<br \/>\n     Prosecutor  to conduct a particular case  is  not<br \/>\n     available.\n<\/p>\n<p>8.   It is also pertinent to mention here that &#8220;Public<br \/>\n     Prosecutor&#8221; has been defined in 2(u) of the  Code<br \/>\n     of  Criminal Procedure, according to  which,  the<br \/>\n     &#8220;Public  Prosecutor&#8221; means any  person  appointed<br \/>\n     under  section 24, and includes any person acting<br \/>\n     under  the  directions  of a  Public  Prosecutor.<br \/>\n     Therefore,  if the Public Prosecutor directs  any<br \/>\n     person  to act as Public Prosecutor, the same  is<br \/>\n     valid   appointment  in  view  of  section  2(u).<br \/>\n     Hence, the Public Prosecutor appointed u\/s 24  of<br \/>\n     Cr.P.C., has power to direct any person to act as<br \/>\n     Public  Prosecutor which the District  Magistrate<br \/>\n     does not enjoy u\/s 25 of Cr.P.C.\n<\/p>\n<p>9.   In  view of the above discussion, we are in  full<br \/>\n     agreement  with  the view taken  by  the  learned<br \/>\n     Single  Judge that the District Magistrate cannot<br \/>\n     appoint  ADPPOs in general on contract basis  u\/s<br \/>\n     25(3) Cr.P.C.  The learned single judge has  also<br \/>\n     directed  that  the  appointments  of  ADPPOs  on<br \/>\n     contract   basis  shall  continue  till   regular<br \/>\n     selection  is made or till the end of the  period<br \/>\n     of   extension   of  appointment,  whichever   is<br \/>\n     earlier.\n<\/p>\n<p>10.  The  service of ADPPOs are essential  service  as<br \/>\n     the  Courts of Magistrates cannot remain  without<br \/>\n     prosecuting  officer, and therefore,  the  Courts<br \/>\n     may  not remain without a prosecuting officer and<br \/>\n     it  was necessary to give some time to the  State<br \/>\n     Government  to make some alternative arrangements<br \/>\n     and as such the learned single judge specifically<br \/>\n     directed that the contractual appointments  shall<br \/>\n     continue  till the end of the period of extension<br \/>\n     of  these ADPPOs granted after the expiry of  the<br \/>\n     period  of  their initial appointments,  but  the<br \/>\n     State  Government  has not made  any  alternative<br \/>\n     arrangements  and  their appointments  of  ADPPOs<br \/>\n     continued  even  after expiry of  the  period  of<br \/>\n     extension of their appointments, which appears to<br \/>\n     be  violative  of the directions of  the  learned<br \/>\n     single judge and we do not expect this action  by<br \/>\n     the State Government.\n<\/p>\n<p>11.  We  have  been  informed  by  the  learned  State<br \/>\n     Counsel  that according to his instructions,  the<br \/>\n     total  number of posts of ADPPOs are 193, out  of<br \/>\n     which, only 51 are working and thus there are 142<br \/>\n     vacancies,  out of which, selection was  made  by<br \/>\n     the Public Service Commission against 99 posts by<br \/>\n     issuing  advertisement, but  the  said  selection<br \/>\n     process    is   under   challenge   in    W.P(S).<br \/>\n     No.6383\/2008, in which, the final arguments  have<br \/>\n     been heard and the judgment has been reserved and<br \/>\n     the  interim order was also granted therein.  The<br \/>\n     statement  of the learned counsel for the  Public<br \/>\n     Service Commission was also recorded in the court<br \/>\n     proceedings  by this Court that &#8220;learned  counsel<br \/>\n     appearing   for  the  Public  Service  Commission<br \/>\n     submits  that  no results shall be declared  till<br \/>\n     the  next  date of hearing.&#8221;  Any how, since  the<br \/>\n     judgment has been reserved, the State had to make<br \/>\n     an  alternative  arrangement complying  with  the<br \/>\n     orders  passed  by the learned  single  Judge  as<br \/>\n     mentioned above.\n<\/p>\n<p>12.  Learned  counsel for the appellants submits  that<br \/>\n     the State Government has acted upon the selection<br \/>\n     list of 2006, in which, their names find place by<br \/>\n     making appointments of Mr. Raj Kumar Mishra,  Mr.<br \/>\n     Slok  Shrivastava, Mr. Krishna  Kumar  Chaturvedi<br \/>\n     and  Miss.  Seema Jagdalla  on 28.7.2009  and  as<br \/>\n     such once the select list of 2006 was being acted<br \/>\n     upon  in  2009,  there was no  occasion  for  the<br \/>\n     District  Magistrate  to  make  appointments   on<br \/>\n     contract basis.\n<\/p>\n<p>13.  Though  the  above facts could be raised  by  the<br \/>\n     writ appellants at the initial stage but the same<br \/>\n     cannot  be considered in the instant writ  appeal<br \/>\n     as  those  contentions are not available  in  the<br \/>\n     writ  petition.  Therefore, for that purpose,  it<br \/>\n     will  be open for the writ appellants to approach<br \/>\n     the  State Government or to take recourse to  any<br \/>\n     further  provisions  of  law,  if  they  are   so<br \/>\n     advised.\n<\/p>\n<p>14.  Learned  counsel  for the writ appellants  states<br \/>\n     that  the  appellants shall  approach  the  State<br \/>\n     Government  by  filing representations  within  a<br \/>\n     week.  If  it  is so, the State Government  shall<br \/>\n     consider the same in the light of the observation<br \/>\n     made above, as early as possible, within a period<br \/>\n     of  one  month  from  the  date  of  moving  such<br \/>\n     representations.\n<\/p>\n<p>15.  The writ appeal stands disposed of with the above<br \/>\n     direction.\n<\/p>\n<p>16.
