And Others\nPetitioner Counsel :- Manoj Gautam\nRespondent Counsel :- C.S.C.\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p>Supplementary affidavit filed today is taken on record.\n<\/p>\n<p>Heard learned counsel for the petitioner, learned counsel who<br \/>\nappears for the Bank and learned Standing Counsel.\n<\/p>\n<p>Challenge in this petition is recovery proceeding by which a<br \/>\nparticular amount is sought to be recovered from the petitioner.<br \/>\nCounsel for the petitioner has made statement at the bar that this is<br \/>\nthe first writ petition against the recovery proceeding and this fact<br \/>\nhas also been stated in the writ petition. Submission is that if<br \/>\nreasonable time is allowed to pay the amount sought to be<br \/>\nrecovered, petitioner may be able to pay the same and irreparable<br \/>\ninjury on account of arrest and auction of property may be<br \/>\navoided.\n<\/p>\n<p>To the aforesaid, learned counsel appearing for Bank submits that<br \/>\nintention of the respondent bank has been never to cause any<br \/>\nirreparable injury to the loanee rather the loan amount was<br \/>\nadvanced with the purpose to improve the petitioner&#8217;s future<br \/>\nprospects and thus if for justifiable reason the amount in terms of<br \/>\nthe agreement has not been paid and now petitioner has bonafide<br \/>\nintention to pay the amount within a reasonable time then if that<br \/>\nliberty is given, it will serve the interest of both sides i.e. petitioner<br \/>\nmay be saved from the riggers of coercive process i.e. arrest,<br \/>\nauction of the properties and at the same time respondent bank will<br \/>\nget its full amount with interest. Thus for grant of reasonable time,<br \/>\nif that is to advance justice, respondents may not have any<br \/>\nobjection.\n<\/p>\n<p>In view of aforesaid, this Court feels in the ends of justice that<br \/>\namount sought to be recovered be permitted to be deposited.\n<\/p>\n<p>Accordingly, this petition is disposed of with the following<br \/>\ndirections :\n<\/p>\n<p> i) Petitioner is to deposit an amount of Rs. 40,000\/- directly in the<br \/>\nconcerned bank within a period of one month from today to show<br \/>\nbonafide on his part.\n<\/p>\n<p>ii) If petitioner deposits the above amount within the time so<br \/>\nallowed then he is permitted to deposit the remaining amount<br \/>\ndirectly in concerned Bank in three installments. In calculating the<br \/>\narrears the amount (if any) already paid will be adjusted.\n<\/p>\n<p>iii) The first instalment may be deposited by 31st October, 2010,<br \/>\nsecond installment by 31st January, 2010, third by 30th<br \/>\nApril,2011. These deposits may be made before the branch of the<br \/>\nBank from where the loan was taken. In case installments are<br \/>\ndeposited in the Bank then only half of the recovery charges will<br \/>\nbe recovered from the petitioner.\n<\/p>\n<p>iv) During period of deposit the recovery proceedings will be kept<br \/>\nin abeyance. In case petitioners defaults in depositing any of the<br \/>\ninstalments within the above stipulated time, it will be open to the<br \/>\nrespondents to start recovery proceedings again by taking coercive<br \/>\nprocess at once.\n<\/p>\n<p>v) Petitioner may file an application for supply of statement of<br \/>\naccount alongwith duly stamped self addressed envelope. In case<br \/>\nany such application is filed, the concerned branch of the Bank<br \/>\nwill give the same to the petitioner after deposit of first instalment<br \/>\nwithin fifteen days.\n<\/p>\n<p>vi) This order will not affect any auction if it has already taken<br \/>\nplace. In that event the petitioner may take appropriate legal<br \/>\nproceedings to set aside the auction under U.P.Z.A. &amp; L.R. Act<br \/>\nand Rules ,1952 or file a suit in accordance with law.\n<\/p>\n<p>vii) It is clarified that this order will not be operative and will not<br \/>\ncome in way of recovery process in any manner, if any other writ<br \/>\npetition has been filed before this Court against the recovery<br \/>\nproceeding for the loan amount.\n<\/p>\n<p>viii) If any fact given from the side of the petitioners are found to<br \/>\nbe incorrect by the bank authorities, it will be open for them to<br \/>\nmove an application for modification\/recall of the order.\n<\/p>\n<p>With the aforesaid direction, writ petition stands disposed of.\n<\/p>\n<p>Order Date :- 15.7.2010<br \/>\nPrabhat\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Jamuna Prasad vs State Of U.P.
