Pertaining to relaxing standards in favour of members<br \/>\nbelonging to Scheduled Castes and Scheduled Tribes in<br \/>\nrelation to promotion, Government of India issued OM No.<br \/>\n8\/12\/69-Estt. (SCT) dated 23.12.70. It reads as under:\n<\/p>\n<blockquote><p>        &#8220;Subject :- Relaxation of standards in favour of<br \/>\n        Scheduled Castes\/Scheduled Tribes candidates in<br \/>\n        departmental   competitive    examinations   for<br \/>\n        promotion and in departmental confirmation<br \/>\n        examinations.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                                    Page 1 of 14<\/span><\/p>\n<blockquote><p>        Attention of the Ministry of Finance etc. is invited<br \/>\n       to Ministry of Home Affairs O.M. No. 1\/1\/70-Est.<br \/>\n       (SCT) dated 25th July, 1970, in which it has been<br \/>\n       provided that in case of direct recruitment,<br \/>\n       whether by examination or otherwise, if sufficient<br \/>\n       number of Scheduled Castes\/Scheduled Tribes<br \/>\n       candidates are not available on the basis of the<br \/>\n       general standard to fill up the vacancies reserved<br \/>\n       for them, candidates belonging to these<br \/>\n       communities may be selected to fill up the<br \/>\n       remaining vacancies reserved for them provided<br \/>\n       that they are not found unfit for appointment to<br \/>\n       such posts or post. A question has been raised<br \/>\n       whether relaxation in the qualifying standards<br \/>\n       could be granted to Scheduled Castes\/Scheduled<br \/>\n       Tribes candidates on the same basis in promotions<br \/>\n       made      through     departmental     competitive<br \/>\n       examinations and in departmental confirmation<br \/>\n       examinations where such examinations are<br \/>\n       prescribed to determine the suitability of<br \/>\n       candidates for confirmation. The matter has been<br \/>\n       carefully considered and it has been decided that<br \/>\n       in promotion\/confirmations made through such<br \/>\n       examinations, Scheduled Castes \/Scheduled Tribes<br \/>\n       candidates who have not acquired the general<br \/>\n       qualifying standards in such examinations could<br \/>\n       also be considered for promotions\/confirmations.<br \/>\n       In other words the qualifying standards in these<br \/>\n       examinations could be relaxed in favour of<br \/>\n       Scheduled Castes\/Scheduled Tribes candidates in<br \/>\n       keeping with the above criterion.&#8221;\n<\/p><\/blockquote>\n<p>2.     A perusal of the Office Memorandum would reveal that<br \/>\nin matters of promotion, qualifying standards could be<br \/>\nrelaxed by the Departmental Promotion Committees in<br \/>\nrelation to members belonging to the Scheduled Castes and<br \/>\nScheduled Tribes.\n<\/p>\n<p>3.     The OM of the year 1970 was clarified, on the subject<br \/>\nwhere promotion was based on seniority subject to fitness;<br \/>\nand on the issue of fitness qua members belonging to the<br \/>\n<span class=\"hidden_text\">W.P.(C) No.8951\/2003                               Page 2 of 14<\/span><br \/>\n Scheduled Castes and Scheduled Tribes, by an Office<br \/>\nMemorandum No.30021\/10\/76-Estt.(SCT) dated 21.1.1977.<br \/>\nIt reads as under:-\n<\/p>\n<blockquote><p>       &#8220;Subject:-     Relaxation of standards in the<br \/>\n       case of Scheduled Castes\/Tribe candidates in<br \/>\n       qualifying examinations for promotion to the<br \/>\n       higher grade on the basis of seniority subject to<br \/>\n       fitness.\n<\/p><\/blockquote>\n<blockquote><p>       The undersigned is directed to refer to this<br \/>\n       Department&#8217;s Office Memorandum No. 8\/12\/69-<br \/>\n       Estt. (SCT) dated, the 23rd December, 1970 in<br \/>\n       which it has been provided that in promotions<br \/>\n       made      through     departmental      competitive<br \/>\n       examinations and in departmental confirmation<br \/>\n       examinations, if sufficient number of Scheduled<br \/>\n       Caste\/Scheduled Tribe candidates are not available<br \/>\n       on the basis of the general standard to fill the<br \/>\n       vacancies reserved, for them Candidates belonging<br \/>\n       to these communities who have not acquired the<br \/>\n       general qualifying standard should also be<br \/>\n       considered for promotion \/ confirmation provided<br \/>\n       they     are    not    found    unfit    for   such<br \/>\n       promotion\/confirmation. A question has been<br \/>\n       raised whether relaxation in qualifying standards<br \/>\n       should be granted to Scheduled Castes and<br \/>\n       Scheduled Tribes candidates on the same basis, in<br \/>\n       promotions on, the basis of seniority subject to<br \/>\n       fitness, where fitness is decided on the basis of<br \/>\n       qualifying examination. The matter has been<br \/>\n       carefully considered and it has now been decided<br \/>\n       that in promotions made on the basis of seniority<br \/>\n       subject to fitness in which there is reservation for<br \/>\n       Scheduled Castes and Scheduled Tribes in<br \/>\n       accordance     with    this  Department&#8217;s     Office<br \/>\n       Memorandum No. 27\/2\/71- Estt. (SCT), dated the<br \/>\n       27th November, 1972 and where a qualifying<br \/>\n       examination is held to determine the fitness of<br \/>\n       candidates for such promotion, suitable relaxation<br \/>\n       in the qualifying standard in such examinations<br \/>\n       should be made in the case of Scheduled<br \/>\n       Caste\/Scheduled Tribe candidates. The extent of<br \/>\n       relaxation should, however, be decided on each<br \/>\n<span class=\"hidden_text\">W.P.(C) No.8951\/2003                              Page 3 of 14<\/span><br \/>\n        occasion whenever such an examination is held<br \/>\n       taking into account all relevant factors including (i)<br \/>\n       the number of vacancies reserved, (ii) the<br \/>\n       performance of Scheduled Caste\/Scheduled Tribe<br \/>\n       candidates as well as general candidates in that<br \/>\n       examination, (iii) the minimum standard of fitness<br \/>\n       for appointment to the post, and also (iv) the<br \/>\n       overall strength of the cadre and that of Scheduled<br \/>\n       Castes and Scheduled Tribes in that cadre.&#8221;\n<\/p><\/blockquote>\n<p>4.     The Constitutional validity of the Office Memorandums<br \/>\nabove-noted       was challenged, on the ground          that the<br \/>\nConstitution of India empowered the Legislature to make<br \/>\nLaws and in the absence of a legislation, the Executive to<br \/>\nmake reservations, for members of the Scheduled Castes and<br \/>\nScheduled Tribes, but did not empower the Executive to<br \/>\nrelax, in favour of members of the Scheduled Castes and<br \/>\nScheduled Tribes, the qualifying norms to be attained for<br \/>\npromotion.\n<\/p>\n<p>5.     The challenge succeeded and the decision is reported<br \/>\nas 1996 (8) JT (SC) 643 S.Vinod Kumar vs. UOI.\n<\/p>\n<p>6.     In view of OM dated 23.12.1970 and OM dated<br \/>\n21.1.1977 being held to be ultra-vires the Constitution, the<br \/>\nGovernment of India issued Office Memorandum dated<br \/>\n22.07.1997, which reads as under:-\n<\/p>\n<blockquote><p>         &#8220;Subject: Reservation       in     promotion-<br \/>\n         Prescription of lower qualifying marks\/ lesser<br \/>\n         standard of evaluation.\n<\/p><\/blockquote>\n<blockquote><p>         The undersigned is directed to say that in<br \/>\n         terms of instructions noted in the margin,<br \/>\n         certain   relaxations\/concessions   in    the<br \/>\n         matter of qualifying marks\/standards of<br \/>\n         evaluation of performance are to be made in<br \/>\n         favour of candidates belonging to the<br \/>\n         Scheduled Castes and the Scheduled     Tribes<br \/>\n<span class=\"hidden_text\">W.P.(C) No.8951\/2003                                Page 4 of 14<\/span><br \/>\n          while considering them for promotion.\n<\/p><\/blockquote>\n<blockquote><p>         2. The validity of such lower qualifying<br \/>\n         marks\/lesser standards of       evaluation was<br \/>\n         called into question in Courts in the context<br \/>\n         of the judgment of the Supreme Court in the<br \/>\n         case of     Indira Sawhney     Vs   Union    of<br \/>\n         India. The Supreme Court, in the case of<br \/>\n         S.Vinod Kumar Vs. Union of India (JT 1996 (8)<br \/>\n         S.C.643) has held that the provision for lower<br \/>\n         qualifying marks\/lesser level of evaluation, in<br \/>\n         the matter of promotion, provided for<br \/>\n         candidates belonging to the Scheduled Castes<br \/>\n         and       the      Scheduled Tribes      under<br \/>\n         Government\u201fs instructions, is not permissible<br \/>\n         under Article 16(4) in view of the command<br \/>\n         contained      in   Article    335    of   the<br \/>\n         Constitution. The Court has further observed<br \/>\n         that even if it is assumed for the sake of<br \/>\n         argument that reservation is permitted by<br \/>\n         Article 16(4) in the matter of promotion, a<br \/>\n         provision for lower qualifying marks or lesser<br \/>\n         level of evaluation is not permissible in the<br \/>\n         matter of promotion, by virtue of Article\n<\/p><\/blockquote>\n<blockquote><p>         335. The Court also held that the protection<br \/>\n         for reservation in promotion for five years,<br \/>\n         given by the Supreme Court, vide para      829<br \/>\n         of the judgement in Indira Swahney\u201fs case, did<br \/>\n         not save the provisions for lower qualifying<br \/>\n         marks\/lesser level of evaluation.\n<\/p><\/blockquote>\n<blockquote><p>         3. It has accordingly been decided to withdraw<br \/>\n         the instructions contained in this Department\u201fs<br \/>\n         O.M. No.8\/12\/69-Estt. (SCT) dated 23\/12\/70<br \/>\n         and O.M. No. 36021\/10\/76-Estt. (SCT) dated<br \/>\n         21.1.1977, so far as these provide for lower<br \/>\n         qualifying         marks for          Scheduled<br \/>\n         Castes\/Scheduled      Tribes    candidates    in<br \/>\n         departmental              qualifying\/competitive<br \/>\n         examinations for promotion. Similarly, the<br \/>\n         relevant portions of para 6.3.2 of the DPC<br \/>\n         guidelines           circulated            vide<br \/>\n         this     Department\u201fs O.M. No.22011\/5\/86-<br \/>\n         Estt.(D) dated 10.4.1989, to the extent that<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                               Page 5 of 14<\/span><br \/>\n          they    provide    for     consideration  of<br \/>\n         Scheduled           Castes\/        Scheduled<br \/>\n         Tribes candidates without reference to merit<br \/>\n         and the prescribed &#8220;bench mark&#8221;, are hereby<br \/>\n         rescinded.\n<\/p><\/blockquote>\n<blockquote><p>         4. It is clarified that the effect of these<br \/>\n         instructions is that henceforth there shall be<br \/>\n         no separate standards of evaluation for<br \/>\n         candidates of the Scheduled Castes\/Scheduled<br \/>\n         Tribes for promotion and assessment of all<br \/>\n         candidates for this purpose will be with<br \/>\n         reference to uniform standards. Any other<br \/>\n         instructions of the Government, which provide<br \/>\n         for lower qualifying marks\/lesser standards<br \/>\n         of evaluation in matters of promotion for<br \/>\n         candidates belonging to the Scheduled<br \/>\n         Castes\/Scheduled Tribes, may also be treated<br \/>\n         as having been modified to this extent.\n<\/p><\/blockquote>\n<blockquote><p>         5. These instructions take immediate effect.\n<\/p><\/blockquote>\n<blockquote><p>         6.   All   Ministries\/Departments    are   also<br \/>\n         requested to bring these instructions to the<br \/>\n         notice of their Attached\/Subordinate Offices<br \/>\n         and      Autonomous     Bodies\/Public    Sector<br \/>\n         Undertakings     under    their   control   for<br \/>\n         compliance.&#8221;\n<\/p><\/blockquote>\n<p>7.     It be highlighted that vide OM dated 22.7.1997, OMs<br \/>\ndated 23.12.1970 and 21.1.1977 were expressly withdrawn.\n<\/p>\n<p>8.     The Constitution 82nd Amendment Act 2000 amended<br \/>\nArticle 335 of the Constitution of India by adding a proviso<br \/>\nthereto, which reads as under:-\n<\/p>\n<blockquote><p>       &#8220;Provided that nothing in this Article shall prevent<br \/>\n       in making of any Provision in favour of the<br \/>\n       members of the Scheduled Castes and Scheduled<br \/>\n       Tribes for relaxation in qualifying marks in an<br \/>\n       Examination or lowering the standards of<br \/>\n       evaluation, for reservation in matters of promotion<br \/>\n       to any class or classes of services or posts in<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                              Page 6 of 14<\/span><br \/>\n        connection with the affairs of the Union or of a<br \/>\n       State.&#8221;\n<\/p><\/blockquote>\n<p>9.     Having empowered itself under the Constitution to relax<br \/>\nqualifying marks or to lower the standards of evaluation for<br \/>\npurposes of induction as also promotion in favour of<br \/>\nmembers belonging to the Scheduled Castes and Scheduled<br \/>\nTribes, on 3.10.2000 the Government of India issued an<br \/>\nOffice Memorandum which reads as under:-\n<\/p>\n<blockquote><p>        &#8220;Subject: Reservation in promotion &#8212; Prescription<br \/>\n       of lower qualifying marks\/lesser standard of<br \/>\n       evaluation.\n<\/p><\/blockquote>\n<blockquote><p>        The undersigned is directed to refer to<br \/>\n       Department of Personnel &amp; Training&#8217;s OM No.<br \/>\n       36012\/23\/96-Estt. (Res) dated 22nd July, 1997 vide<br \/>\n       which various instructions of the Government<br \/>\n       providing for lower qualifying marks\/lesser<br \/>\n       standards of evaluation in matters of promotion<br \/>\n       for candidates belonging to the Scheduled Castes<br \/>\n       and Scheduled Tribes had been withdrawn, on the<br \/>\n       basis of Supreme Court&#8217;s judgement in the case of<br \/>\n       S. Vinod Kumar Vs. Union of India.\n<\/p><\/blockquote>\n<blockquote><p>       2. The undersigned is further directed to say that<br \/>\n       the matter has been reviewed, consequent to<br \/>\n       which the following proviso to Article 335 has<br \/>\n       been incorporated in Constitution by the<br \/>\n       Constitution,  (Eighty-Second Amendment) Act,<br \/>\n       2000:-\n<\/p><\/blockquote>\n<blockquote><p>       &#8220;Provided that nothing in this Article shall prevent<br \/>\n       in making of any Provision in favour of the<br \/>\n       members of the Scheduled Castes and Scheduled<br \/>\n       Tribes for relaxation in qualifying marks in an<br \/>\n       Examination or lowering the standards of<br \/>\n       evaluation, for reservation in matters of promotion<br \/>\n       to any class or classes of services or posts in<br \/>\n       connection with the affairs of the Union or of a<br \/>\n       State.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                               Page 7 of 14<\/span><\/p>\n<blockquote><p>        3. In pursuance of the enabling proviso of Article<br \/>\n       335 of the Constitution, it has now been decided<br \/>\n       to restore, with immediate effect, the relaxations\/<br \/>\n       concessions in matters of promotion for<br \/>\n       candidates belonging to SCs\/STs by way of lower<br \/>\n       way of lower qualifying marks, lesser standards of<br \/>\n       evaluation that existed prior 22.7.1997 and as<br \/>\n       contained in the instructions issued by the<br \/>\n       Department of Personnel and Training from time<br \/>\n       to time including OM No. 8\/12\/69-Estt. (SCT) dated<br \/>\n       23.12.1970, No. 36021\/10\/76-Estt. (SCT) dated<br \/>\n       21.1.1977 and para 6.3.2 of the DPC guidelines<br \/>\n       contained in Department of Personnel and<br \/>\n       Training&#8217;s OM No. 22011\/5\/86- Estt.(D) dated<br \/>\n       10.4.1989. In other words, the effect of these<br \/>\n       instructions would be that the Department of<br \/>\n       Personnel and Training&#8217;s OM No. 36012\/23\/96-<br \/>\n       Estt.(Res) dated 22nd July, 1997 becomes<br \/>\n       inoperative from the date of issue of this OM.\n<\/p><\/blockquote>\n<blockquote><p>      4.    These orders shall take effect in respect of<br \/>\n      selections to be made on or after the date of issue<br \/>\n      of this OM and selections finalised earlier shall not<br \/>\n      be disturbed.\n<\/p><\/blockquote>\n<blockquote><p>        5. All Ministries\/Departments are requested to<br \/>\n       bring these instructions also to the notice of their<br \/>\n       Attached\/Subordinate Offices and Autonomous<br \/>\n       Bodies\/ Public Sector Undertakings tinder their<br \/>\n       control for compliance.&#8221;\n<\/p><\/blockquote>\n<p>10.    A perusal of the Office Memorandum dated 3.10.2000<br \/>\nwould reveal that in view of the enabling proviso i.e. the<br \/>\nproviso to Article 335 of the Constitution, the Government of<br \/>\nIndia reintroduced the relaxation in favour of members<br \/>\nbelonging to the Scheduled Castes and Scheduled Tribes<br \/>\npertaining to promotions and, by way of incorporation by way<br \/>\nof reference, the policy restored was as per the OMs dated<br \/>\n23.12.1970 and 21.1.1977 which were expressly withdrawn<br \/>\nvide OM dated 22.7.1997.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                               Page 8 of 14<\/span><\/p>\n<p> 11.    The petitioner, issued a Circular Letter No.17\/66\/94-PPS<br \/>\ndated 08.12.2000, which reads as under:-\n<\/p>\n<blockquote><p>        &#8220;Sub:-Relaxation in threshold marks for normal<br \/>\n       assessment for SC\/ST employees under para 2.4<br \/>\n       of revised MANAS<\/p>\n<p>       I am directed to state that as per the decision of<br \/>\n       the Government of India notified vide DoPT<br \/>\n       O.M.No.36012\/23\/96-Estt(Res.)-Vol.II        dated<br \/>\n       3.10.2000 to restore with immediate effect, the<br \/>\n       relaxation\/concessions in matter of promotion for<br \/>\n       candidates belonging to SCs\/STs by way of lower<br \/>\n       qualifying marks, lesser standard of evaluation<br \/>\n       that existed prior to 22.7.97, the instructions<br \/>\n       contained in DoPT OM No. 36012\/23\/96-Estt.(Res.)<br \/>\n       dated 22.7.1997 for withdrawing instructions for<br \/>\n       lower qualifying marks\/ lesser standard of<br \/>\n       evaluation for promotion for candidates belonging<br \/>\n       to SCs\/STs, become in operative from the date of<br \/>\n       issue of above Govt. of India, DoPT, OM dated<br \/>\n       3.10.2000.\n<\/p><\/blockquote>\n<blockquote><p>       In the light of the above decision of the Govt. of<br \/>\n       India, the provisions made under the assessment<br \/>\n       scheme made applicable to S&amp;T employees of<br \/>\n       CSIR for less threshold marks for assessment of<br \/>\n       SC\/ST candidates was also required to be<br \/>\n       restored.\n<\/p><\/blockquote>\n<blockquote><p>       The matter has been considered by the competent<br \/>\n       authority and has approved restoration of the<br \/>\n       provision of relaxation in the prescribed threshold<br \/>\n       marks for normal assessment of SC\/ST candidates<br \/>\n       as contained under para 2.4 of revised MANAS,<br \/>\n       which was subsequently modified to 10 marks<br \/>\n       uniformly vide CSIR circular No.17\/66\/94-PPS,<br \/>\n       dated 28.1.97, for the assessments under Revised<br \/>\n       MANAS as well as erstwhile Bye-law 71 (b) scheme<br \/>\n       falling due on or after 3.10.2000.\n<\/p><\/blockquote>\n<blockquote><p>       It is requested that the above decision may kindly<br \/>\n       be brought to the notice of all concerned in your<br \/>\n       Lab.\/Instt. for their information, guidance and<br \/>\n       necessary action.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                              Page 9 of 14<\/span><\/p>\n<p> 12.    It is apparent that petitioner\u201fs circular dated 8.12.2000<br \/>\nwas notifying the applicability and the requirement to<br \/>\nimplement the Government of India\u201fs OM dated 3.10.2000.\n<\/p>\n<p>13.    Pertaining to the respondent, the relevant facts are that<br \/>\nhis entitlement to be assessed to be promoted in the next<br \/>\nhigher grade became due on 9.10.1999.              The assessment<br \/>\nwas not done and the year 2001 was reached. An appraisal<br \/>\nSelf Assessment Report was rejected by the Competent<br \/>\nAuthority and the result thereof was petitioner\u201fs appraisal<br \/>\nbeing downgraded and this was conveyed to the petitioner on<br \/>\n12.7.2001      granting    him   4   weeks\u201f    time    to      submit      a<br \/>\nrepresentation if he so desired.      Before the 4 weeks expired<br \/>\nthe    Appraisal       Assessment    Committee        on      16.7.2001.<br \/>\nRespondent and others were appraised. All were appraised<br \/>\non the same criteria and it be                highlighted       that the<br \/>\nrespondent is a member of a Scheduled Caste.                        In the<br \/>\nappraisal, 30% weightage had to be accorded to the<br \/>\nappraisal reports of the candidates, and needless to state,<br \/>\nthe respondent was affected by his Self Appraisal Report<br \/>\nbeing downgraded.\n<\/p>\n<p>14.    Not being placed in the higher scale, the respondent<br \/>\nfiled an Original Application before the Central Administrative<br \/>\nTribunal and urged therein 2 grounds: (i) that he was<br \/>\nadversely affected by the assessment committee having met<br \/>\non 16.7.2001 inasmuch as his representation against the<br \/>\nlowering of his self assessment as per the appraisal was still<br \/>\npending; and (ii) since by the date the appraisal committee<br \/>\nmet, the Government of India OM dated 3.10.2000 was in<br \/>\nforce, there was no need to apply the same prospectively and<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                                       Page 10 of 14<\/span><br \/>\n ought to have been applied retrospectively i.e. for members<br \/>\nbelonging to Scheduled Castes and Scheduled Tribes a lower<br \/>\nqualifying eligibility norm had to be prescribed.\n<\/p>\n<p>15.     On the matter of self-assessment report, the Tribunal<br \/>\nheld: &#8220;&#8230; on communication of APAR grading on 12.07.2001,<br \/>\nholding of assessment on 16.07.2001 deprives the applicant<br \/>\na     reasonable        opportunity       and         as      such           the<br \/>\nselection\/promotion in violation of the rules vitiates it.&#8221;\n<\/p>\n<p>16.     On the claim for relaxed standards, the Tribunal held:<br \/>\n&#8220;&#8230;if the selection is held after 03.10.2000 relaxed standards<br \/>\nare to be accorded. As such the decision of the respondents<br \/>\ntaken on 08.10.2000 where as per para 2.4 of the revised<br \/>\nMANAS are applicable to the assessment falling due after<br \/>\n03.10.2000 cannot be sustained. In the present case, as the<br \/>\nassessment relates to 1999, but the assessment has taken<br \/>\nplace    only    on    16.07.2001,    i.e.,   after    the       OM    dated<br \/>\n03.10.2000, the selection which is not yet finalised even for<br \/>\nthe year 1999, relaxed standards are to be applied.<br \/>\nAccordingly, the decision of the respondents not to extend<br \/>\nrelaxed standard and marks as envisaged in para 2.4 of the<br \/>\nScheme is unsustainable in law.&#8221;\n<\/p>\n<p>17.     Accordingly, the Tribunal directed petitioner to reassess<br \/>\nthe respondent by relaxing the standards in his favour.\n<\/p>\n<p>18.     As regards the fault found by the Tribunal of the<br \/>\nAppraisal Committee making assessment as on 16.7.2001 in<br \/>\nthe teeth of the respondent being afforded an opportunity on<br \/>\n12.7.2001 to make a representation against his self appraisal<br \/>\nbeing     downgraded,     learned     counsel    for       the   petitioner<br \/>\nconceded that the view taken by the Tribunal was correct but<br \/>\nin respect of the direction issued by the Tribunal wanted this<br \/>\n<span class=\"hidden_text\">W.P.(C) No.8951\/2003                                         Page 11 of 14<\/span><br \/>\n Court to record a fact; that the representation made by the<br \/>\nrespondent had been rejected on 27.12.2001 and thus if any<br \/>\nre-assessment had to be done, it had to be with respect to<br \/>\nthe downgraded appraisal of the respondent.\n<\/p>\n<p>19.    Indeed, the fault found by the Tribunal on the first count<br \/>\nis correct, but we would have expected the Tribunal to have<br \/>\nnoted the fact that in view of respondent\u201fs representation<br \/>\nbeing rejected, it would be useless to direct that the<br \/>\nreassessment would be necessitated on account of the taint.<br \/>\nIt is settled law that a wrong which results in no meaningful<br \/>\neffect, has to be ignored.\n<\/p>\n<p>20.    The second finding of the Tribunal, unfortunately for us,<br \/>\nis without any reasoning from the Tribunal. A finding by way<br \/>\nof conclusion has been stated sans any reason.\n<\/p>\n<p>21.    The second issue raises the question as to what was the<br \/>\neffect of the decision of the Supreme Court in S.Vinod<br \/>\nKumar\u201fs case (supra) on the 2 OMs dated 23.12.1970 and<br \/>\n21.1.1977 in light of the Constitution 82 nd Amendment<br \/>\nempowering         the   lowering   of   standards   and    relaxing<br \/>\nqualifying marks in matters of promotion of members<br \/>\nbelonging to Scheduled Castes and Scheduled Tribes.\n<\/p>\n<p>22.    The Doctrine of Eclipse in relation to enactments or<br \/>\nexecutive instructions held to be ultra vires the Constitution,<br \/>\nafter the cause of unconstitutionality is removed, guides us<br \/>\nthat, being on the Statute Book, the enactment held<br \/>\nunconstitutional will operate \u201eproprio vigore\u201f when the<br \/>\nConstitutional bar is removed i.e. there is no need for a fresh<br \/>\nlegislation to give effect thereto. We may only highlight one<br \/>\ndecision of the Supreme Court on the subject AIR 1958 SC<br \/>\n468 MPV Sundaramier vs. State of A.P.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.8951\/2003                                 Page 12 of 14<\/span><\/p>\n<p> 23.    Can    it   be    said    that   after   the   Constitution     82 nd<br \/>\nAmendment the OMs dated 23.12.1970 and 21.1.1977<br \/>\nbecome operative proprio vigore i.e. on their own strength?\n<\/p>\n<p>24.    They would have, but for the fact that on 22.7.1997,<br \/>\nboth Office Memorandums were expressly withdrawn. This is<br \/>\nevident from paragraph 3 of the OM dated 22.7.1997 which<br \/>\nuses the expression that the instructions contained in the 2<br \/>\nOMs are withdrawn.              Para 4 makes it further clear that<br \/>\nhenceforth uniform standards of evaluation would have to be<br \/>\nfollowed      while      assessing      unreserved     candidates          and<br \/>\nmembers of the Scheduled Castes and Scheduled Tribes.<br \/>\nThus, it cannot be said, in the facts of the instant case that<br \/>\nafter the Constitutional bar was overcome, the 2 Office<br \/>\nMemorandums became operative on their own strength<br \/>\ninasmuch as the Constitutional Amendment came in the year<br \/>\n2000 and 3 years prior thereto in the year 1997, the 2 Office<br \/>\nMemorandums were expressly withdrawn.                   It was only on<br \/>\n3.10.2000 that the Government reintroduced the relaxed<br \/>\nnorms for members belonging to the Scheduled Castes and<br \/>\nScheduled Tribes and merely because, by way of reference,<br \/>\nthe policy laid down in the Office Memorandums dated<br \/>\n23.12.1970 and 21.1.1977 was incorporated in the OM dated<br \/>\n3.10.2000 would not make the said 2 OMs operative between<br \/>\nthe time they were expressly withdrawn i.e. 22.7.1997 and<br \/>\ntill the OM dated 3.10.2000 was issued.\n<\/p>\n<p>25.    Now,     no      conscious    decision    was    taken     by       the<br \/>\nGovernment to make applicable the relaxed norms from a<br \/>\nretrospective date and none can be inferred by implication<br \/>\nbased on the strength of the decision reported as (2006) 6<br \/>\nSCC 289 Vijay vs. State of Maharashtra &amp; Ors. for the reason<br \/>\n<span class=\"hidden_text\">W.P.(C) No.8951\/2003                                       Page 13 of 14<\/span><br \/>\n a conscious decision was taken to make the OM applicable<br \/>\nprospectively and law being that where a Departmental<br \/>\nPromotion Committee or an Appraisal Committee meets<br \/>\nbelatedly and considers matters as of an anterior date, Rules<br \/>\nand Law as applicable on the date as of which assessments<br \/>\nhave to be made would govern the procedures to be followed<br \/>\nand norms to be adopted as existing for the date on which<br \/>\nappraisals have to be done, unless a conscious decision is<br \/>\ntaken by the Government to retrospectively change the rules<br \/>\nof the game, and finding no such conscious decision taken<br \/>\nand on the contrary the conscious decision being to apply the<br \/>\nlaw prospectively, the inevitable conclusion has to be that<br \/>\nthe direction issued by the Tribunal is contrary to law and<br \/>\nthus we dispose of the writ petition setting aside the<br \/>\nimpugned judgment and order dated 10.9.2003.              The writ<br \/>\npetition is allowed and OA No.2949\/2002 filed by the<br \/>\nrespondent is dismissed.\n<\/p>\n<p>26.
