RAMKUMAR, J.\n                 .........................................\n                         B.A. No.475 of 2011\n                ..........................................\n             Dated this the 27th day of January, 2011\n\n                                    ORDER\n<\/pre>\n<p>     Petitioner, who is the 3rd accused in Crime No.459\/2010 of<\/p>\n<p>Rajakkadu Police Station for offences punishable under<\/p>\n<p>Sections 20(b) iiB I.P.C., seeks anticipatory bail.<\/p>\n<p>     2.    The    learned      Public      Prosecutor     opposed     the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated      2-12-2010       of the Apex Court        in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a>     (2010(4) KLT 930),              I am of     the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer        has not had           the advantage of<\/p>\n<p>interrogating the petitioner.          But at the same time,        I am<\/p>\n<p>inclined to permit the petitioner to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>have his application for bail considered by the Spl.Court, NDPS<\/p>\n<p>cases,   Thodupuzha       or    the     Court      having    jurisdiction.<\/p>\n<p><span class=\"hidden_text\">B.A. No.475 \/2011               -:2:-<\/span><\/p>\n<p>Accordingly,     the  petitioner   shall   surrender    before   the<\/p>\n<p>investigating officer on 10.02.2011 or on 11.02.2011 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating material,<\/p>\n<p>if any. In case the investigating officer is of the view that having<\/p>\n<p>regard to the facts of the case arrest of the          petitioner is<\/p>\n<p>imperative he shall record his reasons for the arrest in the case-<\/p>\n<p>diary     as insisted   in   paragraph 129          of   Siddharam<\/p>\n<p>Satlingappa Mhetre&#8217;s case (supra).             The petitioner shall<\/p>\n<p>thereafter be produced before the Spl.Court, NDPS cases,<\/p>\n<p>Thodupuzha or the Court concerned and permitted to file an<\/p>\n<p>application for regular bail.     In case the interrogation of the<\/p>\n<p>petitioner is     without   arresting him,     the   petitioner shall<\/p>\n<p>thereafter       appear before the       Spl.Court, NDPS cases,<\/p>\n<p>Thodupuzha or the Court concerned and apply for regular bail<\/p>\n<p>on the same day or the next day. The Spl.Court, NDPS cases,<\/p>\n<p>Thodupuzha or the Court on being satisfied that the petitioner<\/p>\n<p>has been interrogated by the police shall, after hearing the<\/p>\n<p>prosecution as well,         consider and dispose of             his<\/p>\n<p>application for regular bail preferably on the same date<\/p>\n<p>on which it is filed.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No.475 \/2011                   -:3:-<\/span><\/p>\n<p>      4.
