Respondent\n  (The second respondent is impleaded\n   as per order dated 28.07.08 in\n   W.P.No.3555 of 2008)\n\nPrayer\n\nWrit Petition filed under Article 226 of the Constitution of India\nfor issuance of a Writ of Order or direction or any other appropriate\nWrit and more particularly a Writ of Mandamus, directing the respondent to\nexecute the sale deed in favour of the petitioner on the basis of the\npetitioner's representation dated 27.02.2008, after surveying the land within a\ntime frame to be fixed by this Hon'ble court.\n\n!For Petitioner\t... Mr.N.Murugesan\n^For Respondent\t... No apperance\n         No.1\nFor Respondent\t... Mr.M.Boominathan\n         No.2\n\n:ORDER\n<\/pre>\n<p>\tThis writ petition has been filed to direct the respondent to execute the<br \/>\nsale deed in favour of the petitioner on the basis of the petitioner&#8217;s<br \/>\nrepresentation dated 27.02.2008, after surveying the land within a time frame to<br \/>\nbe fixed by this Court.\n<\/p>\n<p>\t2. Heard the learned counsel for the petitioner and also<br \/>\nMr.S.Chellapandian, learned counsel for the second respondent.  There is no<br \/>\nrepresentation for the first respondent.\n<\/p>\n<p>\t3.  \tThe nutshell facts, which are absolutely necessary and germane for<br \/>\nthe disposal of this Writ Petition  would ran thus:\n<\/p>\n<p>\t4. The petitioner deposited all the amounts, according to him with the R1<br \/>\nviz., Slum Clearance Board and thereby entitled himself to get the sale deed<br \/>\nexecuted in his favour, from R1.  In the meanwhile, because of the interference<br \/>\nof R2, viz, the second respondent, the R1 is not executing the sale deed.<br \/>\nAdmittedly the second respondent is in possession of a portion of the area,<br \/>\nrelating to which the R1 is expected to execute the sale deed in favour of the<br \/>\npetitioner.\n<\/p>\n<p>\t5. According to the learned counsel for the petitioner, the second<br \/>\nrespondent is none, but his tenant, whereas it appears the contention of the<br \/>\nlearned counsel for the second respondent is to the contrary that he is having<br \/>\nindependent right over the property and that a civil suit is pending between the<br \/>\npetitioner and the second respondent at the instance of the second respondent.\n<\/p>\n<p>\t6. Heard the learned counsel for the  second respondent.\n<\/p>\n<p>\t7. Hence, in these circumstances, I would like to make it clear that the<br \/>\ncontract is between the petitioner and the first respondent, without prejudice<br \/>\nto the right of the second respondent to prosecute his case in the pending<br \/>\ninjunction suit, the first respondent has to execute the sale deed in favour of<br \/>\nthe petitioner within a period of 2 months from the date of receipt of a copy of<br \/>\nthis order, if at all the petitioner fulfilled all the terms and conditions,<br \/>\nwhich are just and necessary for getting the sale deed executed in his favour.\n<\/p>\n<p>\t8. To the risk of repetition without being tautologous, this emergence of<br \/>\nsale deed would not in any way affect the right of the second respondent,  if he<br \/>\nis having one, which he could prove before the Court or in his injunction suit.\n<\/p>\n<p>\t9. With the above said observations, this Writ Petition is disposed of.<br \/>\nNo costs.
