JUSTICE S. D. ANAND\n\nPresent:    Mr. L.M.Gulati, Advocate for the appellant.\n\n            Mr. K.D.Sacheva, Deputy Advocate for the respondent\n\n\nS. D. ANAND, J.\n<\/pre>\n<p>            The appellant stood surety in the sum of Rs.10,000\/- for the<\/p>\n<p>appearance, on every date of hearing, of his father who was facing a<\/p>\n<p>prosecution before the learned Trial Court.<\/p>\n<p>            His father absented from the Court. The bond furnished by<\/p>\n<p>the appellant was forfeited. A penalty of Rs.10,000\/- was ordered to be<\/p>\n<p>recovered from him.\n<\/p>\n<p>            At the time of motion hearing, learned counsel for the<\/p>\n<p>appellant volunteered a statement that the appellant would deposit half of<\/p>\n<p>the penalty amount within two days from 5.9.2008. The commitment has<\/p>\n<p>been honoured by deposit of a sum of Rs.5000\/- in the Court of learned<\/p>\n<p>Addl. Sessions Judge, Amritsar on 6.9.2008. Photo-stat copy of the<\/p>\n<p>relevant receipt has been produced and is taken on record.<\/p>\n<p>            It is beyond the pale of controversy that the father of the<\/p>\n<p>appellant has since appeared before the learned Trial Court and has not<\/p>\n<p>absented thereafter.\n<\/p>\n<p><span class=\"hidden_text\"> Criminal Appeal No.1633-SB of 2008                             -2-<\/span><\/p>\n<p>                                       ***<\/p>\n<p>            In the light of peculiar circumstances of the case, it is ordered<\/p>\n<p>that the penalty imposed upon the petitioner shall stand reduced from<\/p>\n<p>Rs.10,000\/- to Rs.5000\/-.\n<\/p>\n<p>            Disposed of accordingly.\n<\/p>\n<\/p>\n<pre>September 12, 2008                                  (S.
