Bihari Yadav son of Sri Ghamandi Yadav\n                                                  Versus\n                                           The State Of Bihar\n                                                -----------\n<\/pre>\n<p>2.   21.9.2011               Heard learned counsel for the petitioners and the<\/p>\n<p>                 State.\n<\/p>\n<p>                             The petitioners are apprehending their arrest in a<\/p>\n<p>                 case registered under Sections 273 and 328 of the Indian<\/p>\n<p>                 Penal Code.\n<\/p>\n<p>                             It has been submitted that the First Information<\/p>\n<p>                 Report has been instituted on suspicion that it was the liquor<\/p>\n<p>                 purchased from the shop of the petitioner, that had caused the<\/p>\n<p>                 illness of the informant&#8217;s husband and now the matter has<\/p>\n<p>                 been compromised.\n<\/p>\n<p>                           Considering the same, let the petitioners above<\/p>\n<p>                 named be released on anticipatory bail in the event of arrest<\/p>\n<p>                 or surrender before the learned court below within a period of<\/p>\n<p>                 12 weeks from today in connection with Bhagwanganj P.S.<\/p>\n<p>                 case No.65 of 2010 on furnishing bail bonds of Rs.10,000\/-<\/p>\n<p>                 (Ten thousand) with two sureties of the like amount each to<\/p>\n<p>                 the satisfaction of S.D.J.M., Masaurhi, subject to the<\/p>\n<p>                 conditions as laid down under Section 438(2) of the Code of<\/p>\n<p>                 Criminal Procedure as also conditions (i) That one of the<\/p>\n<p>                 bailor will be a close relative of the petitioners who will give an<\/p>\n<p>                 affidavit giving genealogy as to how he is related with the<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            petitioners. The bailor will undertake to furnish information to<\/p>\n<p>            the Court about any change in address of the petitioners. (ii)<\/p>\n<p>            That the affidavit shall clearly state that the petitioners are not<\/p>\n<p>            an accused in any other case and if they are they shall not be<\/p>\n<p>            released on bail, (iii) That the bailor shall also state on<\/p>\n<p>            affidavit that he will inform the court concerned if the<\/p>\n<p>            petitioners are implicated in any other case of similar nature<\/p>\n<p>            after their release in the present case and thereafter the court<\/p>\n<p>            below will be at liberty to initiate the proceeding for<\/p>\n<p>            cancellation of bail on ground of misuse, (iv) That the<\/p>\n<p>            petitioners will give an undertaking that they will receive the<\/p>\n<p>            police papers on the given date and be present on date fixed<\/p>\n<p>            for charge and if they fail to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, their bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (v) That the petitioners will<\/p>\n<p>            be well represented on each date if they fail to do so on two<\/p>\n<p>            consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bharat Yadav &amp; Anr. vs The State Of Bihar on 21 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
