Justice K.T.SANKARAN\n\n Dated :15\/11\/2010\n\n O R D E R\n                  K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.20756 OF 2009\n          ------------------------------\n     Dated this the 15th day of November, 2010\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The grievance voiced by the petitioner is that<\/p>\n<p>though he is included as the 4th rank holder in the<\/p>\n<p>main list in the ranked list published on 31.7.2007<\/p>\n<p>for appointment to the post of ECG Technician under<\/p>\n<p>the  Medical  Education  Department  of  the   State<\/p>\n<p>Government, he did not get appointment due to non<\/p>\n<p>reporting of vacancies.     The learned Government<\/p>\n<p>Pleader submitted that as per the special rules,<\/p>\n<p>the appointment of ECG technicians is by direct<\/p>\n<p>recruitment as well as by promotion from qualified<\/p>\n<p>junior lab assistants in the ratio 1:1.      In the<\/p>\n<p>additional statement dated 14th January, 2010, filed<\/p>\n<p>on behalf of the third respondent, it is stated<\/p>\n<p>that  the   total   sanctioned   strength   of   ECG<\/p>\n<p>Technician in the Medical Education service is 39.<\/p>\n<p>As such, admissible number of PSC recruited hands<\/p>\n<p>would be 20.    At present, 21 PSC recruited ECG<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.20756 OF 2010    2<\/span><\/p>\n<p>technicians     are    working in   the   Department.<\/p>\n<p>Therefore, no substantive vacancy is liable to be<\/p>\n<p>reported. The learned counsel for the petitioner<\/p>\n<p>submitted that the vacancies are not filled up even<\/p>\n<p>now and ad hoc appointments of ECG technicians are<\/p>\n<p>being made. When the quota earmarked for direct<\/p>\n<p>appointees is already filled up, the petitioner<\/p>\n<p>could not be said to be an aggrieved person in the<\/p>\n<p>matter of appointment of persons on ad hoc basis.<\/p>\n<p>The persons aggrieved would be a persons who are<\/p>\n<p>entitled to get promotion from the quota earmarked<\/p>\n<p>for junior lab assistants.      On that ground also,<\/p>\n<p>the   grievance voiced by the petitioner    could not<\/p>\n<p>be sustained.
