Justice K.HEMA\n\n Dated :31\/05\/2010\n\n O R D E R\n                                  K.HEMA, J\n                               --------------------\n                  Bail Application No.3025 Of 2010\n                 -------------------------------------------------\n                 Dated this the 31st day of May 2010\n\n                                    ORDER\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<\/p>\n<p>      2. The alleged offences are under Sections 143, 144, 147,<\/p>\n<p>148, 149, 452, 326, 324, 427 &amp; 354 of the IPC. According to<\/p>\n<p>prosecution, petitioner (A1) along with other accused formed into<\/p>\n<p>an unlawful assembly and trespassed into the house of the<\/p>\n<p>de facto complainant and assaulted de facto complainant, his son<\/p>\n<p>and his wife using deadly weapons. Iron rod was used by the<\/p>\n<p>petitioners and injuries were sustained by all the injured. De facto<\/p>\n<p>complainant&#8217;s son sustained fracture to the nasal bone.<\/p>\n<p>      3. Learned counsel for the petitioner submitted that there<\/p>\n<p>was a dispute between the de facto complainant and CITU workers<\/p>\n<p>in respect of loading and unloading.                  Since there was some<\/p>\n<p>unpleasant talk between the petitioner and de facto complainant<\/p>\n<p>in the morning of the date of occurrence, de facto complainant<\/p>\n<p>suspected that the petitioner and others committed the offence<\/p>\n<p>and filed complaint.       Petitioners are innocent of the allegation<\/p>\n<p>made.\n<\/p>\n<p>      4. Learned counsel for the de facto complainant and learned<\/p>\n<p>Public Prosecutor are heard. This petition is opposed. Learned<\/p>\n<p><span class=\"hidden_text\">Bail Application No.3025 Of 2010      2<\/span><\/p>\n<p>Public Prosecutor submitted that three persons were injured in the<\/p>\n<p>incident. The first accused has used an iron rod and a fracture is<\/p>\n<p>sustained by de facto complainant&#8217;s son.          The name of the<\/p>\n<p>petitioner is stated in the First Information Statement itself. This<\/p>\n<p>was an motivated attack. It was also submitted by learned Public<\/p>\n<p>Prosecutor that petitioner along with others came to the de facto<\/p>\n<p>complainant&#8217;s house where he was selling live chicken. Petitioner<\/p>\n<p>and other persons who came for chicken were abusing each other<\/p>\n<p>and the de facto complainant asked them to wait outside and also<\/p>\n<p>told them that the chicken would be supplied to their car. This<\/p>\n<p>was not to the liking of the de facto complainant and incurated by<\/p>\n<p>this, the de facto complainant and his family members were<\/p>\n<p>attacked. This petition is opposed.\n<\/p>\n<p>       5.
