Justice M.SASIDHARAN NAMBIAR\n\n Dated :14\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO. 3193 OF 2009\n              ------------------------------------------\n\n              Dated       14th     October 2009\n\n\n                           O R D E R\n<\/pre>\n<p>          Petitioner is the accused in C.C.285\/2009 on<\/p>\n<p>the  file  of  Judicial          First       Class      Magistrate-IV,<\/p>\n<p>Kozhikode  taken   cognizance          for      the     offence under<\/p>\n<p>Section 3(1) of P.D.P.P Act on Annexure-E                        final<\/p>\n<p>report. Prosecution case is that while lying Optic<\/p>\n<p>Fiber Cable in Calicut city damage was caused to PWD<\/p>\n<p>road and thereby the accused committed offence under<\/p>\n<p>Section 3(1) of the P.D.P.P Act. This petition is<\/p>\n<p>filed under Section 482 of Code of Criminal Procedure<\/p>\n<p>to quash the proceedings contending that the entire<\/p>\n<p>damages caused were already paid by the petitioner and<\/p>\n<p>in view of the payment of the damages, it is not in<\/p>\n<p>the interest of justice to continue the prosecution.<\/p>\n<p>         2.   Learned         counsel         appearing      for   the<\/p>\n<p>petitioner and learned Public Prosecutor were heard.<\/p>\n<p>         3.   Annexure-C intimation of the                   Assistant<\/p>\n<p>Executive Engineer, PWD, Roads Sub Division, Kozhikode<\/p>\n<p>dated 6\/10\/2008 to the Circle Inspector of Police,<\/p>\n<p>CRMC 3193\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Nadakkavu shows that though case was registered, on a<\/p>\n<p>complaint filed against M\/s.Vodafone Essar Cellular<\/p>\n<p>Ltd.,  for   the  purpose  of     recovering  loss  to<\/p>\n<p>Government   property   on  account   of   unauthorised<\/p>\n<p>trenching of PWD road    by   the firm,    M\/s.Vodafone<\/p>\n<p>Essar Cellular Ltd. has come forward to remit the<\/p>\n<p>necessary damages caused by trenching of the road and<\/p>\n<p>the Executive Engineer, Roads Division, Kozhikode has<\/p>\n<p>accorded permission for trenching of PWD road for<\/p>\n<p>lying Optic Fiber Cable to      the firm    subject to<\/p>\n<p>realisation   of  reformation   charges  and  in   such<\/p>\n<p>circumstances, complaint lodged against M\/s.Vodafone<\/p>\n<p>Essar  Cellular   Ltd.  is  to  be   withdrawn. Circle<\/p>\n<p>Inspector was requested to drop the action initiated<\/p>\n<p>against the petitioner.\n<\/p>\n<p>          4.   Annexure-G statement of the Assistant<\/p>\n<p>Executive Engineer, PWD, Roads Division        recorded<\/p>\n<p>under  Section  161   of  Code  of  Criminal  Procedure<\/p>\n<p>establish that M\/s.Vodafone Essar Cellular Ltd. had<\/p>\n<p>deposited   Rs.2,38,602\/- before the Executive Engineer<\/p>\n<p>towards the     reformation charge of English Church<\/p>\n<p>Cross Road RS.80,408\/-, towards reformation of Mini<\/p>\n<p>Bye-pass   road  Rs.80,408\/-  towards  reformation   of<\/p>\n<p>CRMC 3193\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>Nadakkavu   cross   road  Rs.77,786\/-   and   together<\/p>\n<p>Rs.2,38,602\/-   is deposited in the treasury. In such<\/p>\n<p>circumstances, it is  submitted that it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<pre>          5.   Learned    Public    Prosecutor    also\n\nsubmitted that the offence alleged     is against the\n\n<\/pre>\n<p>petitioner is causing damages to the public road by<\/p>\n<p>unlawful trenching and the  entire damages caused were<\/p>\n<p>already realised,  there is no objection for quashing<\/p>\n<p>the proceedings.\n<\/p>\n<p>               In  such  circumstances,   petition  is<\/p>\n<p>allowed.
