Basheer, J.\n\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.A.No. 1861 OF 2008\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 16th day of September, 2009\n\n                              JUDGMENT\n<\/pre>\n<p>S.R.Bannurmath, C.J.\n<\/p>\n<p>      Aggrieved by the conformation of the award by the<\/p>\n<p>learned Single Judge, the Management Bank has approached<\/p>\n<p>this Court in the present appeal.\n<\/p>\n<p>      2.    Respondent No.1 workman who was working as<\/p>\n<p>sweeper with the Management for more than 240 days was<\/p>\n<p>aggrieved by the termination of her service by way of<\/p>\n<p>retrenchment and approached the Industrial Tribunal. After<\/p>\n<p>giving opportunity to both sides and considering the material<\/p>\n<p>records produced, the Tribunal through the impugned award<\/p>\n<p>found that the Management Bank has not produced all the<\/p>\n<p>documents       necessary      for adjudication         including     those<\/p>\n<p>requested by the workman and as such drawing adverse<\/p>\n<p>inference and even otherwise finding that the workman has<\/p>\n<p>established that she had worked for more than 240 days,<\/p>\n<p>passed the impugned award holding that the action of the<\/p>\n<p>Management in terminating the services of the workman is<\/p>\n<p>illegal and as such directed the Management to reinstate her<\/p>\n<p>WA No.1861 of 2008<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>in service with continuity of service and 50% of back wages.<\/p>\n<p>     3. Aggrieved by the same, the Management approached<\/p>\n<p>this Court. In the impugned judgment the learned Single Judge<\/p>\n<p>has taken into consideration all the facts once again and on<\/p>\n<p>re-appreciation of the entire materials, affirmed the award. So<\/p>\n<p>far as the question of delay as alleged by the Management is<\/p>\n<p>concerned, though the Tribunal awarded entire back wages, the<\/p>\n<p>learned Single Judge has deemed it proper in the facts and<\/p>\n<p>circumstances of the case and because of the delay, restrict the<\/p>\n<p>back wages to 50% as against the full back wages awarded by<\/p>\n<p>the Tribunal.\n<\/p>\n<p>     We find that there are absolutely no grounds made out to<\/p>\n<p>hold that the judgment of the learned Single Judge is either<\/p>\n<p>arbitrary, illegal or perverse.    Hence we find no merit in the<\/p>\n<p>appeal and the same is rejected.\n<\/p>\n<\/p>\n<p>                                           S.R.
