The averments made in the<br \/>\n\tapplication have been supported by the affidavit sworn in by Shri<br \/>\n\tG.P.Rathod, Under Secretary, Legal Department, Sachivalaya,<br \/>\n\tGandhinagar. It is, inter alia, stated that because of inter<br \/>\n\tdepartment and intra departmental proceedings considerable time has<br \/>\n\tbeen consumed and, therefore, the delay has occurred in filing the<br \/>\n\tabove-numbered Criminal Appeal. He has, therefore, prayed to condone<br \/>\n\tthe delay.\n<\/p>\n<p>Having<br \/>\n\theard Mr.L.B.Dabhi, learned APP for the applicant   State of<br \/>\n\tGujarat, Mr.Subhash Barot, learned advocate for the respondents and<br \/>\n\tupon perusal of the averments made in the Application, which have<br \/>\n\tremained uncontroverted and the celebrated principles governing the<br \/>\n\tdiscretionary exercise of power conferred under Section 5 of the<br \/>\n\tAct, so also the reported decisions of the Hon&#8217;ble Supreme Court<br \/>\n\tconstruing Section 5 of the Act liberally, we are of the considered<br \/>\n\topinion that the applicant has aptly, elaborately and sufficiently<br \/>\n\texplained the delay caused in filing the Criminal Appeal. There was<br \/>\n\tno negligence or inaction on the part of the applicant in<br \/>\n\tprosecuting the Appeal. The explanation offered by the applicant for<br \/>\n\tcondonation of delay is not only plausible, but acceptable.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, according to us, this application deserves to<br \/>\n\tbe allowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeeds and accordingly it<br \/>\n\tis allowed. The delay of 33 days caused in filing the above-numbered<br \/>\n\tCriminal Appeal is condoned.
