1.These appeals arise from the decree in O.S.77\/89 of the Sub<\/p>\n
  Court, Kottarakkara. That suit was filed by the Central Bank<\/p>\n
  of India which has filed A.S.235\/96. The connected appeal<\/p>\n
  A.S.245\/96 is filed by the third defendant, arrayed as<\/p>\n
  guarantor.\n<\/p>\n<\/p>\n
2.The plaintiff contended that it advanced a loan to the first<\/p>\n
  defendant for the purpose of purchasing a bus and that<\/p>\n
  defendants 1 and 2 created collateral security by deposit of<\/p>\n
  title deeds of an immovable property belonging to them and<\/p>\n
  that the third defendant, the brother of the first defendant,<\/p>\n
  was the guarantor.\n<\/p>\n

 3.Defendants 1 and 2 filed a written statement taking the stand<\/p>\n
    that the first defendant wanted to buy a TATA Benz Bus and<\/p>\n
    the bank represented to them they could buy a ‘Ford’ vehicle<\/p>\n
    and that loan could be granted on personal security rather<\/p>\n
    than on any other collateral security. They contended that<\/p>\n
    they got a Ford vehicle which ultimately turned out to be not<\/p>\n
    worth. They pleaded that the alleged security documents<\/p>\n
    were not created and they had issued different signed blank<\/p>\n
    papers to the officers of the bank which have been utilised for<\/p>\n
    the purpose of filing the suit.\n<\/p>\n<\/p>\n
 4.The third defendant, arrayed as guarantor, filed written<\/p>\n
    statement stating that he went along with his sister, the first<\/p>\n
    defendant as it was told to him that he has to sign certain<\/p>\n
    documents as a witness and he signed the documents under<\/p>\n
    that belief and he never intended to be a guarantor for the<\/p>\n
    transaction.\n<\/p>\n

 5.The court below repelled the plea of the third defendant that<\/p>\n
    he is not the guarantor, however, found that the security<\/p>\n
    documents were not appropriately created and that there is<\/p>\n
    no equitable mortgage by deposit of title deeds. Resultantly,<\/p>\n
    the suit was decreed against defendants 1 to 3 and their<\/p>\n
    assets without giving any charge decree or for sale of the<\/p>\n
    plaint B schedule property, which, according to the bank, was<\/p>\n
    the subject matter of the mortgage.\n<\/p>\n<\/p>\n
 6. In its appeal A.S.235\/96, the bank challenges the decree to<\/p>\n
    the extent it refuses a decree for sale of the mortgage<\/p>\n
    properties. The third defendant has filed A.S.245\/96 to the<\/p>\n
    extent the decree finds him also liable as a guarantor.<\/p>\n
 7.We may first deal with the third defendant’s appeal<\/p>\n
    A.S.245\/96. Adverting to his written statement, it can be<\/p>\n
    seen that the plea raised by him was that his sister, the first<\/p>\n
    defendant, approached him and wanted him to accompany<\/p>\n

    her to the bank to sign as a witness in certain documents and<\/p>\n
    that he signed the documents relied on by the plaintiff on the<\/p>\n
    belief that he is only a witness. The third defendant pleaded<\/p>\n
    that he had not offered himself as a guarantor. He, therefore,<\/p>\n
    contended that he is not liable for the plaint claim.<\/p>\n
 8.The first defendant, the sister of the third defendant, gave<\/p>\n
    evidence regarding the circumstance in which the third<\/p>\n
    defendant along with the second defendant executed the<\/p>\n
    document. DW1 had stated before the court below that she<\/p>\n
    wanted to purchase a TATA Benz bus and was prepared to<\/p>\n
    remit the price of the vehicle and offer immovable property<\/p>\n
    as security. She says that however, the Manager of the bank<\/p>\n
    told her to purchase a Ford bus. She, accordingly, says that<\/p>\n
    she agreed to the suggestion of the plaintiff’s Manager and<\/p>\n
    defendants 2 and 3 offered themselves as guarantors and it<\/p>\n
    was accordingly, that the documents were signed.<\/p>\n

 9.The third defendant was examined as DW2.              He gave<\/p>\n
    evidence that he had a conversion with          the Manager<\/p>\n
    regarding the loan. He admitted that the terms of Ext.A3<\/p>\n
    were feasible and he signed Ext.A3 after having understood<\/p>\n
    that it is a guarantee form. Under such circumstances, the<\/p>\n
    court below found that defendants 2 and 3 had executed<\/p>\n
    Ext.A4 knowing that they were put as guarantors for the<\/p>\n
    repayment of the loan sanctioned by the plaintiff to the first<\/p>\n
    defendant.\n<\/p>\n<\/p>\n
 10.We further notice that the third defendant is not an illiterate<\/p>\n
    person. He was an Engineer in the Cochin Shipyard. He had<\/p>\n
    stated in his cross examination that he would not sign<\/p>\n
    documents without reading and understanding its contents.<\/p>\n
    Though he had said before the court below that he had not<\/p>\n
    understood the purpose of the document when he signed it,<\/p>\n
    we are unable to appreciate that stand of the third defendant.<\/p>\n
    He, as already noted, had stated that there was a discussion<\/p>\n

    between the parties and the Manager of the bank. We are,<\/p>\n
    therefore, inclined to take the view that the court below had<\/p>\n
    rightly appreciated the evidence and the decree passed<\/p>\n
    against the third defendant does not warrant interference.<\/p>\n
 11.Adverting to the appeal of the bank, A.S.235\/96, it has to be<\/p>\n
    noted that the plea of defendants 1 and 2 in relation to the<\/p>\n
    creation of the equitable mortgage as collateral security was<\/p>\n
    that the first defendant was called upon to furnish personal<\/p>\n
    security and the defendants were compelled to sign certain<\/p>\n
    papers       without revealing details  of   the  documents.<\/p>\n
    According to defendants 1 and 2, they were unaware of the<\/p>\n
    fraud played by the plaintiff on them.   They took the stand<\/p>\n
    that they have not executed any agreement and no guarantee<\/p>\n
    was furnished. The did not, however, deny the fact that they<\/p>\n
    have deposited the title deeds of the property in question<\/p>\n
    with the bank. Adverting to the documentary evidence, it can<\/p>\n
    be seen that the bank had produced the original of the<\/p>\n

    documents standing in the name of defendants 1 and 2 before<\/p>\n
    the court below.       The fact that they had deposited the<\/p>\n
    documents evidence the mortgage.          There was also no<\/p>\n
    specific plea for defendants 1 and 2 in their written statement<\/p>\n
    that they have not created any mortgage by deposit of title<\/p>\n
    deeds.      Therefore, the court below erred in refusing the<\/p>\n
    decree to be for sale of the suit properties to recover the<\/p>\n
    plaint claim and charged on the plaint B schedule property.<\/p>\n
 12.For the aforesaid reasons, A.S.235\/96 is entitled to succeed<\/p>\n
    and A.S.245\/96 is liable to be dismissed.<\/p>\n
       In the result,<\/p>\n
              (i) A.S.No.245\/96 is dismissed.\n<\/p>\n<\/p>\n
              (ii) A.S.No.235\/96 is allowed modifying the decree<\/p>\n
       passed by the court below by allowing the plaintiff to<\/p>\n

       recover the decree amount by sale of the plaint B schedule<\/p>\n
       property. The appellant will be entitled to costs of appeal<\/p>\n
       A.S.No.235\/96 from defendants 1 and 2.\n<\/p>\n<\/p>\n
