The Inspector of Police,\n   Prohibition Enforcement\n   Department(Unit-I),\n   Avinashi, Coimbatore District,\n   Coimbatore.                          Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a Writ of Habeas Corpus to call for the records of the detention\norder  made  in  Cr.M.P.10\/BL\/2006\/E4  dated  27.3.2006,  District  Collector,\nCoimbatore  District,  the second respondent herein, set aside the same and to\ndirect the respondents to produce the detenu Murugan @ Manusan S\/o Palani  now  \nconfined  in Central Prison at Coimbatore before this Court and set the detenu\nat liberty.\n\n!For Petitioner :  Mr.G.K.R.Pandian\n^For Respondents:  Mr.M.Babu Muthu Meeran    \n                   Addl.  Public Prosecutor\n\n:ORDER  \n<\/pre>\n<p>                (Order of the Court was made by V.DHANAPALAN,J.)<\/p>\n<p>        The petitioner, who is the wife  of  the  detenu  by  name  Murugan  @<br \/>\nManusan,  who is detained as a &#8221;Bootlegger&#8221; as contemplated under V the Tamil<br \/>\nNadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest<br \/>\nOffenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates<br \/>\nAct, 1982 (Tamil Nadu Act 14 of 1982), by the impugned detention  order  dated<br \/>\n27.03.2006, challenges the same in this Petition.\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nAdditional Public Prosecutor for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is enormous delay in disposal of the representation of the detenu, which<br \/>\nvitiates the ultimate order of detention.  With reference to the above  claim,<br \/>\nlearned  Additional  Public Prosecutor has placed the details, which show that<br \/>\nthe representation of the  detenu  dated  0  5.03.2006  was  received  by  the<br \/>\nGovernment  on  06.04.2006  and  remarks  were  called  for  on 07.04.2006 and<br \/>\nreminder was  sent  on  18.04.2006  and  the  remarks  were  received  by  the<br \/>\nGovernment on  the  same  day  i.e.    on  1  8.04.2006  and the File was also<br \/>\nsubmitted on the same day i.e.  on 18.04.2006 and the same was dealt  with  by<br \/>\nthe  Under  Secretary  and  Deputy  Secretary  on  19.04.2006 and finally, the<br \/>\nMinister for  Prohibition  and  Excise  passed  orders  on  20.04.2006.    The<br \/>\nrejection  letter  was  prepared  on  10.05.2006  and the same was sent to the<br \/>\ndetenu on 12.05.2006 and served to him on 17.05.2006.  As rightly pointed  out<br \/>\nby the learned counsel for the petitioner, though the Minister for Prohibition<br \/>\nand  Excise  passed an order on 20.04.2006, there is no explanation at all for<br \/>\ntaking time for preparation of rejection letter till  10.05.200  6.    In  the<br \/>\nabsence  of  any  explanation by the person concerned even after excluding the<br \/>\nintervening holidays, we are of the view that the time taken  for  preparation<br \/>\nof  rejection letter is on the higher side and we hold that the said delay has<br \/>\nprejudiced the detenu in disposal of his representation.  On this  ground,  we<br \/>\nquash the impugned order of detention.\n<\/p>\n<p>        4.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>raa<\/p>\n<p>To<\/p>\n<p>1.
