Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n              ------------------------------------------\n               CRL.M.C.NO. 3289 OF 2009\n              ------------------------------------------\n              Dated       13th     October 2009\n\n                           O R D E R\n<\/pre>\n<p>            Petitioner         is      the      first    accused  in<\/p>\n<p>S.C.7\/2009 on the file of Assistant Sessions court,<\/p>\n<p>Kozhikode. Offences alleged are under Sections 111 and<\/p>\n<p>306 read with Section 34 of Indian Penal Code. This<\/p>\n<p>petition  is  filed     under       Section        482   of Code  of<\/p>\n<p>Criminal Procedure for a direction to the Assistant<\/p>\n<p>Sessions court to consider            Ext.P7 petition filed by<\/p>\n<p>him for exemption from personal appearance.<\/p>\n<p>         2.   Learned         counsel         appearing    for  the<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>         3.   Learned           counsel            submitted    that<\/p>\n<p>petitioner will not dispute the identity and evidence<\/p>\n<p>in the case could be recorded in the presence of his<\/p>\n<p>counsel and second accused the son of the petitioner<\/p>\n<p>would  also  be   available         and      petitioner    will not<\/p>\n<p>challenge  the  evidence         so      recorded       and in  such<\/p>\n<p>circumstances,  learned Assistant Sessions Judge                 may<\/p>\n<p>be directed to dispense presence of the petitioner.<\/p>\n<p>CRMC 3289\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          4.   Section  317  of   Code  of   Criminal<\/p>\n<p>Procedure enables Sessions Judge on his satisfaction,<\/p>\n<p>for reasons to be recorded, that personal attendance<\/p>\n<p>of the accused before the court is not necessary in<\/p>\n<p>the  interest  of  justice,  to  dispense  with   his<\/p>\n<p>attendance and proceed with the trial in his absence<\/p>\n<p>and direct   personal attendance of the accused at a<\/p>\n<p>later stage.\n<\/p>\n<p>          5.    I find no reason to believe that if a<\/p>\n<p>proper petition is filed under Section 317 of Code of<\/p>\n<p>Criminal Procedure by an accused, undertaking that on<\/p>\n<p>his behalf his counsel will appear on all the dates<\/p>\n<p>posted for trial and evidence could be recorded    in<\/p>\n<p>his absence, treating presence of his counsel as his<\/p>\n<p>presence and that he will not challenge the evidence,<\/p>\n<p>so  recorded,  before   that  court  or  before   the<\/p>\n<p>appellate court   or the revisional court, Assistant<\/p>\n<p>Sessions Judge will not invoke the power available<\/p>\n<p>under Section 317 of Code of Criminal Procedure and<\/p>\n<p>will  not   grant  exemption   from  appearance.
