\nThe material facts of the  ‘ea_sev’jdisclose that,
\none Manjunath Bhat is llhe\ufb01appellant no.1 (Al) is<\/p>\n
s\/0 the deceased. The Appe_llan.t  {Ali-)3  grand S\/0. the<\/p>\n
deceased and  “S\/ti).  No.3 (A3) is the<\/p>\n
brotherwin\u00e9law. caselagaii1st”JA3 is split up.\n<\/p>\n
2. …,,A’ll;’l1ere  between A1 and his family<\/p>\n
on the one  and tthte’~~’deceased on the other part. The<\/p>\n
“V’deAcease;i:l …_\ufb011edAAla’s~u–it’in O.S.No.23\/2003 on the \ufb01le of Civil<\/p>\n
  :3z’~i.ngeri for partition. The deceased was living<\/p>\n
   seconjdfson K.lV\u00a3.R.S.Bhat — PW1 at Bangalore at the<\/p>\n
 ‘time of theincident. On 16.04.2003, the accused hired the taxi<\/p>\n
   from Sringeri to Bangalore. PW15 is the driver of the<\/p>\n
  The deceased was brought from Bangalore to Sringeri in<\/p>\n
it 2  pp  taxi. On 16.4.2003 in the night around 8.00 p.m., there was<\/p>\n
a discussion between the deceased and the accused regarding<\/p>\n
the property dispute. The accused persons caused murder and<\/p>\n

buried the dead body in the backyard of the house. The Villagers
\nwere informed that, the deceased had gone on pilgrimage to<\/p>\n
Kashi.\n<\/p>\n
3. The whereabouts of the deceased was  :_for _<\/p>\n
quite a long time. The PW1 from whose house _the.. was–\u00ab .. <\/p>\n
taken by the accused became apprehensiy,efjvai’i,d<\/p>\n
habeas corpus. A1 had also \ufb01led.*a.writ ofhabeasup   T.<\/p>\n
View, this Court referred the mattei=.,to CCBVllforgiinyestigation. In
\nthe course of investigationiit.rev_eals: to A15} brought the
\ndeceased from Bangalore byV_Ca_r  had killed him<\/p>\n
and buried him’ ti\ufb01pd-‘the;i_backyard,:.’  instance of one<\/p>\n
Surnithra,}l-‘””lJllIl2’i’3;’ lithe buried in the backyard is
\nrecovered.z7PW23Vis  the incident. The dead body was<\/p>\n
identified as that of the deceased. The police also sent the skull<\/p>\n
vof.,the,,rdead body xalo’ng’V with the latest photographs of the<\/p>\n
deceased fo\u00ab:j’si1″per”imposition test. The report discloses that, the<\/p>\n
T T   skull’  the photographs of the deceased person. The<\/p>\n
 accused are’;.charged for committing offences U\/Ss. 120(8), 342,<\/p>\n
  3::2,,2oa,,, 182, 4.o41Pc. The charge U\/Ss. 342, 182 and 404 IPC<\/p>\n
 dappwegars to be silly and redundant.\n<\/p>\n
4\u00bb. It is the case of the prosecution that, gold rings
\nworn by the deceased were taken by the accused. The said act<\/p>\n
amounts to robbery. llowever, no charge is framed for robbery.<\/p>\n

A2 has sold M.Os.1 and 2 (2 gold rings] to PW20. The gold rings
\nare recovered from the possession of PW20. PW1 had identi\ufb01ed<\/p>\n
the rings as belonging to his father.\n<\/p>\n
5. The evidence of PW23 disclose that _<\/p>\n
the taxi and went to Bangalore, brought the _deoeiased-iitogtiieirti <\/p>\n
house. On 16.4.2003 there was a discussion\u00bb <\/p>\n
property around 8.00 p.m. in the4__front”.ya’rd of.ythee  <\/p>\n
was inside the house. A2 and  the—dVecvease.d without
\ncausing any visible injurie’g~w..anciVAhlatef..Qr1.Ithey buried the dead
\nbody in the backyard. Theggeyidyeiice of discloses that, A2<\/p>\n
hired the taxi toggoito-.Ban.ga1oi*e to”brin’g..th.e deceased. PW15 is<\/p>\n
the driver”ef’the.’i5W15 disclose that that, A2.
\nA3 trave1evd.Wi\u00abthV  and they reached Bangalore at<\/p>\n
1.00 p.m.v in the Vnighit. ‘i’hey”‘to1d PW15 that they had informed<\/p>\n
it the jovsi1ri1ey.:of…the deceased to Sringeri and asked him to go and
\n:’d.eceased\u00ab..from the house of PW1, accordingly, PW15
\n   brotightithei  and they all went to Sringeri. The evidence
\nef_yyPw2io..ai;._eiese that, A2 sold M.Os.1 and 2 for Rs.10,000\/\u00bb~
\n  ahtdiiyvat-the\ufb02ivoluntary instance of the accused poiice had come to<\/p>\n
  and he had produced the said rings under mahazar<\/p>\n

6. PW1 gives evidence that, he identi\ufb01ed the dead body<\/p>\n
and also rings M.0s.1 and 2 as beionging to his father. PW}<\/p>\n

leading questions A1 is not implicated. A2 and A3 are alone<\/p>\n
indicted.\n<\/p>\n
‘7. PW29 is the witness who conducted super<\/p>\n
imposition test, his evidence discloses that the photogra,phs<\/p>\n
under Ex.P55 of the deceased tallies with the <\/p>\n
examination. The Trial Court on the basis of the .. <\/p>\n
convicted A1 U\/Ss. 365, 342, 182 and <\/p>\n
for an offence U\/Ss. 364, 365, .342, 4o’4.,.V_1’a2 afi\u00e9lvll’-3″Q’:2u’.1P\u00a2. <\/p>\n
accused persons are in appeal.\n<\/p>\n
8. The facts and’*evidei1ce;_dvoesnotisuggest the case of<\/p>\n
abduction. Therefore,  and 865 IPC is<\/p>\n
not sound ‘and  evidence of PW23 does not<\/p>\n
incriminate A1 “in naybmaniger. A2 and A8 are alone indicted.<\/p>\n
_._The \ufb01vildence of’ ‘ri_’7l2:&vV72O supports the recovery evidence and<\/p>\n
 A2:.”~in that View of the matter, conviction of A1 is set<\/p>\n
aside.._;\n<\/p>\n
 PW23 who is none other than his mother has<\/p>\n
   A2 of causing the murder of the deceased and burying<\/p>\n
“t’thAe,dead body. There is nothing to doubt the veracity of evidence<\/p>\n
u”‘.,ovflHPW23. The conviction of A2 for an offence U\/ s. 302 IPC is<\/p>\n
sound and proper.\n<\/p>\n

Hence, on over an consideration of the facts and evidence,
\nthe order of conviction passed against A1 is set aside. ‘1’;h”c_7order<\/p>\n
