Heard learned counsel for petitioner and learned counsel<\/p>\n<p>                  for the State.\n<\/p>\n<p>                               The petitioner apprehends his arrest in connection with a<\/p>\n<p>                  case in which cognizance has been taken for the offence under<\/p>\n<p>                  section 498A and section 4 of the Dowry Prohibition Act.<\/p>\n<p>                               As per prosecution case, the complainant was subjected<\/p>\n<p>                  to cruelty on account of non-fulfillment of demand of dowry. It is<\/p>\n<p>                  also alleged that ultimately the complainant was driven out from her<\/p>\n<p>                  matrimonial home.\n<\/p>\n<p>                               Learned counsel for the petitioner submits that the facts<\/p>\n<p>                  narrated in the complaint are not true. He further submits that the<\/p>\n<p>                  petitioner&#8217;s sister is married to the complainant&#8217;s brother. There was<\/p>\n<p>                  matrimonial dispute in the house of the petitioner&#8217;s sister and<\/p>\n<p>                  ultimately she was compelled to institute a case against the<\/p>\n<p>                  complainant&#8217;s brother under section 498A of the Indian Penal Code.<\/p>\n<p>                  The said case was registered as Pranpur P.S. Case No.61 of 2010 on<\/p>\n<p>                  17.7.2010. It is submitted on behalf of the petitioner that<\/p>\n<p>                  immediately thereafter in retaliation the complainant instituted the<\/p>\n<p>                  present case on 19.7.2010.\n<\/p>\n<p>                                   Taking into consideration the aforesaid facts and<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        circumstances of the case as also the fact that the case has arisen out<\/p>\n<p>        of a complaint, let the petitioner, namely, Prakash Singh in the event<\/p>\n<p>        of his arrest or surrender before the court below within a period of<\/p>\n<p>        four weeks from the date of communication of the order be released<\/p>\n<p>        on bail on furnishing bail bonds of Rs.5,000\/- (five thousand) with<\/p>\n<p>        two sureties of the like amount each to the satisfaction of C.J.M.,<\/p>\n<p>        Katihar in connection with Complaint Case C.A.No.2043 of 2010.<\/p>\n<pre>Md.S.
