            This appeal is directed against the order dated 9.5.2007 passed<\/p>\n
by Additional Civil Judge (Senior Division), Ferozepur (Exercising the<\/p>\n
powers of learned District Judge, Ferozepur) whereby an application under<\/p>\n
the Indian Succession Act, 1925 (for short `the Act’) has been allowed and<\/p>\n
succession certificate has been issued to the applicant Jaskirat Kaur<\/p>\n
(respondent No.1).\n<\/p>\n
            At the very outset, learned counsel for respondent No.1 has<\/p>\n
contended that the present appeal filed by the appellants (respondents No.2<\/p>\n
and 3 before the Court below) under Section 384(1) of the Act is not<\/p>\n
maintainable. It is contended that according to Section 384(1) of the Act, an<\/p>\n
appeal shall lie to the High Court from an order of the District Judge
\n FAO No.2524 of 2007             -2 –<\/span><\/p>\n
granting, refusing or revoking a certificate and the High Court may, if it<\/p>\n
thinks fit, by its order on the appeal declare the person to whom the<\/p>\n
certificate should be granted and direct the learned District Judge on<\/p>\n
application being made, therefore, to grant it accordingly, in supersession of<\/p>\n
the certificate, if any, already granted. He further contended that application<\/p>\n
under Section 372 of the Act has been filed before the Additional Civil<\/p>\n
Judge (Sr.Divn.) Ferozepur exercising the powers of learned District Judge<\/p>\n
as a delegate of the District Judge in view of the provisions of Section 388<\/p>\n
(1) of the Act. He further submits that if the application under Section 372<\/p>\n
of the Act has been filed under Section 388(1) of the Act then according to<\/p>\n
its Proviso, the appeal shall lie under Section 388(2) of the Act to District<\/p>\n
Judge and not to the High Court. The relevant provisions of Sections 384<\/p>\n
and 388 are reproduced as under :\n<\/p>\n
            “Section 384. Appeal- (1) Subject to the other provisions of<\/p>\n
            this Part, an appeal shall lie to the High Court from an order of<\/p>\n
            a District Judge granting, refusing or revoking a certificate<\/p>\n
            under this Part, and the High Court may, if it thinks fit, by its<\/p>\n
            order on the appeal, declare the person to whom the certificate<\/p>\n
            should be granted and direct the District Judge, on application<\/p>\n
            being made therefore, to grant it accordingly, in supersession of<\/p>\n
            the certificate, if any, already granted.\n<\/p><\/blockquote>\n
            (2)An appeal under sub-section (1) must be preferred within the<\/p>\n
               time allowed for an appeal under the Code of Civil<\/p>\n
               Procedure, 1908 (5 of 1908).\n<\/p><\/blockquote>\n
            (3)Subject to the provisions of sub section (1) and to the<\/p>\n
               provisions as to reference to and revision by the High Court
\n FAO No.2524 of 2007          -3 –<\/span><\/p>\n
            and as to review of judgment of the Code of Civil Procedure,<\/p>\n
            1908, (5 of 1908.) as applied by Section 141 of that Code, an<\/p>\n
            order of a District Judge under this Part shall be final.”<\/p>\n
          “Section 388 Investiture of inferior Courts with jurisdiction<\/p>\n
          of District Court for purposes of this Act – (1) The State<\/p>\n
          Government may by notification in the Official Gazette, invest<\/p>\n
          any Court inferior in grade to a District Judge with power to<\/p>\n
          exercise the functions of a District Judge under this Part.<\/p>\n
          (2)Any inferior Court so invested shall, within the local limits<\/p>\n
            of its jurisdiction, have concurrent jurisdiction with the<\/p>\n
            District Judge in the exercise of all the powers conferred by<\/p>\n
            this Part upon the District Judge, and the provisions of this<\/p>\n
            Part relating to the District Judge shall apply to such an<\/p>\n
            inferior Court as if it were a District Judge :<\/p>\n<\/blockquote>\n
                Provided that an appeal from any such order of an<\/p>\n
          inferior Court as is mentioned in sub section (1) of Section 384<\/p>\n
          shall lie to the District Judge, and not to the High Court, and<\/p>\n
          that the District Judge may, if he thinks fit, by his order on the<\/p>\n
          appeal, make any such declaration and direction as that sub<\/p>\n
          section authorises the High Court to make by its order on an<\/p>\n
          appeal from an order of a District Judge.\n<\/p><\/blockquote>\n
          (3)An order of a District Judge on an appeal from an order of<\/p>\n
            an inferior Court under the last foregoing sub section shall,<\/p>\n
            subject to the provisions as to reference to and revision by<\/p>\n
            the High Court and as to review of judgment of the Code of<\/p>\n
            Civil Procedure, 1908 (5 of 1908), as applied by section 141
\n FAO No.2524 of 2007            -4 –<\/span><\/p>\n
              of that Code, be final.\n<\/p><\/blockquote>\n
            (4)The District Judge may withdraw any proceedings under this<\/p>\n
              Part from an inferior Court, and may either himself dispose<\/p>\n
              of them or transfer them to another such Court established<\/p>\n
              within the local limits of the jurisdiction of the District Judge<\/p>\n
              and having authority to dispose of the proceedings.<\/p>\n
            (5) A notification under sub section (1) may specify any<\/p>\n
              inferior Court specially or any class of such Courts in any<\/p>\n
              local area.\n<\/p><\/blockquote>\n
            (6)Any Civil Court which for any of the purposes of any<\/p>\n
              enactment is subordinate to, or subject to the control of, a<\/p>\n
              District Judge shall, for the purposes of this section, be<\/p>\n
              deemed to be a Court inferior in grade to a District Judge.”<\/p><\/blockquote>\n
            In order to substantiate his argument, learned counsel for<\/p>\n
respondent No.1 has relied upon decisions in Mosamatt Parmeshwari<\/p>\n
Devi and another v. Geeta Devi and others AIR 2001 PATNA 107;<\/p>\n
Vadia Banerjee Vs. Sardar 1999(2) Civil Court Cases 129(H.P.);<\/p>\n
Karunamoyee Sett & Others Vs. Lakshmirani Devi & Others 1994(1)<\/p>\n
HLR 37 (DB) (Cal) AND Manohar son of Bapurao Sapre Vs. Bhaurao<\/p>\n
son of Tukaramji Shirbhate and another AIR 1996 Bombay 29.<\/p>\n
            I have given my thoughtful consideration to the contentions<\/p>\n
raised by learned counsel for respondent No.1 and perused the record.<\/p>\n
            Undisputedly, in this case the powers of learned District Judge<\/p>\n
have been delegated to the Civil Judge (Sr.Division), Ferozepur who has<\/p>\n
decided the application under Section 372 of the Act. Had the application<\/p>\n
been decided by the District Judge himself in whatever manner, the appeal
\n FAO No.2524 of 2007             -5 –<\/span><\/p>\n
would have definitely been maintainable before the High Court but since the<\/p>\n
application under Section 372 of the Act has been decided by a delegate of<\/p>\n
the District Judge then in view of Proviso to Section 388(1)(2), the appeal<\/p>\n
shall lie to the District Judge and not to the High Court. In the case of<\/p>\n
Mosammat Parmeshwari Devi and another Vs. Geeta Devi and others<\/p>\n
(supra), it is held as under:\n<\/p>\n
                     “It is manifest from the provision of S.388(2) and its<\/p>\n
             proviso clause that any inferior Court who has been invested<\/p>\n
             with the power to exercise the function of a District Judge shall<\/p>\n
             within the local limits of its jurisdiction have concurrent<\/p>\n
             jurisdiction with the District Judge in exercise of all the powers<\/p>\n
             conferred by this part upon the District Judge but the proviso<\/p>\n
             clause makes it abundantly clear that where the inferior Court<\/p>\n
             has passed any order under sub-sec.(1) of S.384, then the<\/p>\n
             appeal shall lie to the District Judge and not to the High Court.”<\/p>\n<\/blockquote>\n
                     “The submission of the learned counsel that the District<\/p>\n
             Judge has got no pecuniary jurisdiction to entertain an apper<\/p>\n
             where the jurisdiction exceeds Rs.One lac has got no force in it<\/p>\n
             because there is no such bar under the Act. The decision cited<\/p>\n
             by the learned counsel in the case of Bhim Singh Vs. Mohan<\/p>\n
             Lal Agarwal, 1991(2) Pat.LJR 325, will have no application<\/p>\n
             in this case which relates to the case under the general<\/p>\n
             provision of the C.P.C. and not under the provision of this<\/p>\n
             Act.”\n<\/p><\/blockquote>\n
                      “Relying upon the aforesaid decision, I hold that the<\/p>\n
             appeal against the order passed by the Subordinate Judge shall
\n FAO No.2524 of 2007            -6 –<\/span><\/p>\n
            lie to the District Judge and not before the High Court in view<\/p>\n
            of the provision of S.388 (2) and proviso clause of the Act.”<\/p>\n
            Similar view is taken in Vadia Banerjee Vs. Sardar (supra);<\/p>\n<\/blockquote>\n
Karunamoyee Sett & Others Vs. Lakshmirani Devi & Others (supra)<\/p>\n
and Manohar son of Bapurao Sapre Vs. Bhaurao son of Tukaramji<\/p>\n
Shirbhate and another (supra).\n<\/p>\n
            In view of the consistent view of different High Courts on this<\/p>\n
issue, I hold that the present appeal is not maintainable having been filed<\/p>\n
before this Court against the order passed by Addl.Civil Judge (Sr.Division)<\/p>\n
Ferozepur, who has decided the case as a delegate of the District Judge.<\/p>\n
Therefore, the present appeal is dismissed as such.<\/p>\n
            At this stage, learned counsel for the appellant has prayed that<\/p>\n
the present appeal has been filed in this Court in compliance with the<\/p>\n
provisions of Section 388(3) of the Act within the period of limitation under<\/p>\n
the mistaken belief that since the Addl.Civil Judge (Sr.Divn.) has exercised<\/p>\n
the powers of District Judge, therefore, the appeal tantamounts to have been<\/p>\n
decided by the District Judge himself.\n<\/p>\n
            In view of the peculiar facts and circumstances of the case, the<\/p>\n
appeal is disposed of with liberty to the appellant to file an appeal against<\/p>\n
the order passed by Addl.Civil Judge (Sr.Divn.), Ferozepur dated 9.5.2007<\/p>\n
before the appropriate Court in accordance with law.<\/p>\n
