No.11103 of 2007\n\n                 In       this             petition       filed       under\n\nArticle    226\/227      of       the       Constitution        of    India,\n CWP No.11103 of 2007                                  [2]\n\n\n\n<\/pre>\n<p>petitioners (eight in number) pray for issuance<\/p>\n<p>of a writ in the nature of certiorari, quashing<\/p>\n<p>Order dated 17.1.2007 (Annexure P-1) whereby the<\/p>\n<p>pay of the petitioners has been refixed after a<\/p>\n<p>period of more than nine years and recovery of<\/p>\n<p>various     amounts      from      the    petitioners       has   been<\/p>\n<p>ordered to be effected.\n<\/p>\n<p>                   Learned            counsel         for         the<\/p>\n<p>petitioners, at the very outset, contends that<\/p>\n<p>the   prayer      of    the    petitioners      is   confined      to<\/p>\n<p>quashing of recovery only. There is no challenge<\/p>\n<p>to the refixation itself.\n<\/p>\n<p>                Learned counsel for the petitioners has<\/p>\n<p>argued that the case of the petitioners would be<\/p>\n<p>covered      under      the     judgment      rendered       by    the<\/p>\n<p>Hon&#8217;ble Full Bench of this Court in Civil Writ Petition<\/p>\n<p>No.2799 of 2008 <a href=\"\/doc\/1434376\/\">(Budh Ram &amp; Others vs. State of Haryana &amp;<\/p>\n<p>Others),<\/a> decided on 22.5.2009.\n<\/p>\n<p>                It has further been contended that the<\/p>\n<p>petitioners       had    not       actuated   the    pay    fixation<\/p>\n<p>initially. The petitioners have not played any<\/p>\n<p>role in that regard.\n<\/p>\n<p>                Learned counsel for the respondents has<\/p>\n<p>not been able to dispute the fact that there has<\/p>\n<p>been neither any misrepresentation nor any fraud<\/p>\n<p>played     on    behalf       of    the   petitioners.       Learned<\/p>\n<p>counsel has further not been able to distinguish<br \/>\n CWP No.11103 of 2007                                            [3]<\/p>\n<p>the judgment in Budh Ram&#8217;s case (supra).<\/p>\n<p>              I have considered the issue.\n<\/p>\n<p>              In      Budh Ram&#8217;s case (supra),              the       following<\/p>\n<p>three questions were framed for determination:-<\/p>\n<blockquote><p>               i)    Cases in which the benefits sought to be recovered from<br \/>\n                     the employees were granted to them on the basis of any<br \/>\n                     fraud, misrepresentation or any other act of deception;<\/p>\n<blockquote><p>              ii)    Cases in which the benefits sought to be recovered were<br \/>\n                     granted on the basis of a bonafide mistake committed by<br \/>\n                     the authority granting the same while applying or<br \/>\n                     interpreting a provision contained in the service rule,<br \/>\n                     regulation or any other memo or circular authorizing such<br \/>\n                     grant regardless whether or not grant of benefits involved<br \/>\n                     the performance of higher or more onerous duties by the<br \/>\n                     employee concerned;\n<\/p><\/blockquote>\n<blockquote><p>              iii)    Cases that do not fall in either one of the above two<br \/>\n                     categories but where the nature of the benefit and extent is<br \/>\n                     so unconnected with his service conditions that the<br \/>\n                     employee must be presumed to have known that the benefit<br \/>\n                     was flowing to him undeservedly because of a mistake by<br \/>\n                     the authority granting the same.\n<\/p><\/blockquote>\n<blockquote><p>              For        considering            the       claim        of      the<\/p>\n<p>petitioner, consideration of question No.2 would<\/p>\n<p>be   relevant.         Full      Bench        of    this       Court        while<\/p>\n<p>considering question No.2, extracted above, has<\/p>\n<p>held in the following terms:-\n<\/p><\/blockquote>\n<blockquote><p>                    &#8220;It is in the light of the above pronouncement, no longer<br \/>\n              open to the authorities granting the benefits, no matter<br \/>\n              erroneously, to contend that even when the employee concerned<br \/>\n              was not at fault and was not in any way responsible for the<br \/>\n              mistake committed by the authorities, they are entitled to<br \/>\n              recover the benefit that has been received by the employee on<br \/>\n              the basis of any such erroneous grant. We say so primarily<br \/>\n              because if the employee is not responsible for the erroneous<br \/>\n              grant of benefit to him\/her, it would induce in him the belief that<br \/>\n              the same was indeed due and payable. Acting on that belief the<br \/>\n              employee would, as any other person placed in his position<br \/>\n              arrange his affairs accordingly which he may not have done if he<br \/>\n              had known that the benefit being granted to him is likely to be<br \/>\n              withdrawn at any subsequent point of time on what may be then<br \/>\n              said to be the correct interpretation and application of rules.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>              Having induced that belief in the employee and made him<br \/>\n              change his position and arrange his affairs in a manner that he<br \/>\n              would not otherwise have done, it would be unfair, inequitable<br \/>\n CWP No.11103 of 2007                                             [4]<\/p>\n<p>                and harsh for the Government to direct recovery of the excess<br \/>\n                amount simply because on a true and correct interpretation of<br \/>\n                the rules, such a benefit was not due. It does not require much<br \/>\n                imagination to say that additional monetary benefits going to an<br \/>\n                employee may not always result in accumulation of his<br \/>\n                resources and savings. Such a benefit may often be utilized on<br \/>\n                smaller luxuries of life which the employee and his family may<br \/>\n                not have been able to afford had the benefit not been extended to<br \/>\n                him. The employees can well argue that if it was known to them<br \/>\n                that the additional benefit is only temporary and would be<br \/>\n                recovered back from them, they would not have committed<br \/>\n                themselves to any additional expenditure in their daily affairs<br \/>\n                and would have cut their coat according to their cloth. We have,<br \/>\n                therefore, no hesitation in holding that in case the employees<br \/>\n                who are recipient of the benefits extended to them on an<br \/>\n                erroneous interpretation or application of any rule, regulation,<br \/>\n                circular and instructions have not in any way contributed to such<br \/>\n                erroneous interpretation nor have they committed any fraud,<br \/>\n                misrepresentation, deception to obtain the grant of such benefit,<br \/>\n                the benefit so extended may be stopped for the future, but the<br \/>\n                amount already paid to the employees cannot be recovered from<br \/>\n                them.&#8221;<\/p><\/blockquote>\n<p>                From the facts of the present case, it<\/p>\n<p>is     made     out    that       the     petitioner           had      neither<\/p>\n<p>played        any     fraud      nor      had      misrepresented              the<\/p>\n<p>facts.\n<\/p>\n<p>                In view of the above, this petition is<\/p>\n<p>allowed       in    terms      of     judgment         rendered         by     the<\/p>\n<p>Hon&#8217;ble Full Bench of this Court in Civil Writ Petition<\/p>\n<p>No.2799 of 2008 <a href=\"\/doc\/1434376\/\">(Budh Ram &amp; Others vs. State of Haryana &amp;<\/p>\n<p>Others),<\/a> decided on 22.5.2009.<\/p>\n<pre>\n\n                                                                (AJAI LAMBA)\nAugust 03, 2009                                                    JUDGE\navin\n\n\n\n\n<\/pre>\n<p>1.
