JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nAppeal, preferred under Clause 15 of the Letters Patent, arises from<br \/>\nthe order dated 29th November, 2007 made by the learned<br \/>\nSingle Judge in above Special Civil Application No.26711 of 2007.\n<\/p>\n<p>\tThe<br \/>\nappellant is the son of the deceased employee. After the death of his<br \/>\nfather in the year 1996, he, on attaining majority, applied for<br \/>\ncompassionate employment in the year 2004. Nonetheless, his<br \/>\napplication came to be rejected as his elder sister had not applied<br \/>\nfor compassionate employment as and when she attained the age of<br \/>\nmajority. The decision of the respondent Government has been upheld<br \/>\nby the learned Single Judge.\n<\/p>\n<p>\tIt<br \/>\nis not in dispute that the mother of the appellant was eligible for<br \/>\nemployment. If the family of the deceased were in dire need of<br \/>\nassistance, the mother of the appellant, wife of the deceased<br \/>\nemployee, ought to have applied for compassionate employment. Neither<br \/>\nthe widow applied for compassionate employment nor did the eldest<br \/>\nchild on her attaining the majority. It is well settled that the<br \/>\ncompassionate employment is offered to the eligible member of the<br \/>\nfamily of the deceased with a view to meet the sudden crises suffered<br \/>\nby the family. The family cannot be said to be suffering 8 years<br \/>\nafter the death of the deceased employee.\n<\/p>\n<p>\tNo<br \/>\ncase for interference is made out.
