Justice V.GIRI\n\n Dated :09\/07\/2008\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                    W.P.(C).20619\/2008\n                       --------------------\n             Dated this the 9th day of July, 2008\n\n                        JUDGMENT\n<\/pre>\n<p>      Petitioner, who is Preventive Officer in the Excise<\/p>\n<p>Office, Karunagappally, is aggrieved by Ext.P12 order of<\/p>\n<p>suspension issued by the Excise Commissioner.            The<\/p>\n<p>Excise commissioner was required to suspend the<\/p>\n<p>petitioner, as evidenced by Ext.P11 communication issued<\/p>\n<p>by the Government. Government had apparently referred<\/p>\n<p>to Ext.P7 report of the Excise Vigilance, submitted after an<\/p>\n<p>enquiry into the allegation against the petitioner by an<\/p>\n<p>accused in Crime No.45\/2006 of Karunagappally Excise<\/p>\n<p>Range.    Apparently    in the course of enquiry into the<\/p>\n<p>complaint, certain other aspects were also looked into and<\/p>\n<p>in Ext.P7 report, there is a recommendation, requiring the<\/p>\n<p>petitioner to be transferred. There is also a tentative<\/p>\n<p>finding that for extraneous reasons, an innocent man had<\/p>\n<p>been arrested or caused to be arrested and that the<\/p>\n<p>petitioner has indulged in several irregularities. There is<\/p>\n<p>also a recommendation that there            should be a fresh<\/p>\n<p>investigation into crime No.45\/2006 of Karunagappally<\/p>\n<p>W.P.(C).20619\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>Excise Range.\n<\/p>\n<\/p>\n<p>2.    Ext.P7 is only one of the materials which would be<\/p>\n<p>available in the course of any enquiry that may be<\/p>\n<p>conducted against the petitioner. Obviously, findings<\/p>\n<p>therein are only tentative.\n<\/p>\n<\/p>\n<p>3.    Government and the Competent Authority are<\/p>\n<p>entitled to take note of it and then decide whether a<\/p>\n<p>detailed disciplinary enquiry is necessary. A reading of<\/p>\n<p>Ext.P12 will show that the Excise Range Commissioner<\/p>\n<p>had taken note of the fact that the accused in crime<\/p>\n<p>No.45\/2006 was kept in jail for a period of 76 days.<\/p>\n<p>According to the learned counsel for the petitioner, this<\/p>\n<p>was because there was nobody to enlarge him on bail.<\/p>\n<p>There is also a reference to the alleged practice being<\/p>\n<p>followed by the petitioner, where he stands proximate to<\/p>\n<p>a retail liquor shop, and accerts the persons who come<\/p>\n<p>from out of the shop and then receives money from them,<\/p>\n<p>for not charging them with any offence under the Abkari<\/p>\n<p>W.P.(C).20619\/2008<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>Act. These are of course, matters on which an enquiry<\/p>\n<p>will be necessary. But it cannot be said that there is<\/p>\n<p>total non application of mind on the part of either the<\/p>\n<p>Government or the Excise Commissioner in suspending<\/p>\n<p>the petitioner. I do not therefore, find any grounds to<\/p>\n<p>interfere with Exts.P11 and P12.\n<\/p>\n<\/p>\n<p>4.    Nevertheless, since the reference made in Ext.P12<\/p>\n<p>are only tentative, it is open to the petitioner to place<\/p>\n<p>all available materials before the Government, to show<\/p>\n<p>that there is no reason why the petitioner should be kept<\/p>\n<p>under suspension. Such a right is made available to the<\/p>\n<p>petitioner under Rule 10(6) of the K.C.S. (C.C. &amp; A)<\/p>\n<p>Rules, 1960.\n<\/p>\n<\/p>\n<p>5.    In the circumstances,    if the petitioner files an<\/p>\n<p>application under Rule 10(6) of the Rules within three<\/p>\n<p>weeks from today, before the Government, Government<\/p>\n<p>shall treat the same either as an application for<\/p>\n<p>revocation or as an appeal against the order of<\/p>\n<p>W.P.(C).20619\/2008<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>suspension issued by the Commissioner and then take a<\/p>\n<p>decision thereon, within four months thereafter.
