PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Mr Dabhi, learned APP waives service of notice of Rule on behalf of<br \/>\nthe State.\n<\/p>\n<p>\tThe<br \/>\napplicants prays for regular bail in connection with the offences<br \/>\nregistered as Prohibition C.R.No.5161\/2011 with Amirgadh Police<br \/>\nStation  for the offences punishable under sections 66(B), 65(A)(E),<br \/>\n81, 116(B), 98 and 99 of Bombay Prohibition Act.\n<\/p>\n<p>\tI<br \/>\nhave heard learned advocate Mr. M.M. Shaikh for the applicants and Mr<br \/>\nDabhi, learned Additional Public Prosecutor for the respondent &#8211;<br \/>\nState.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the accused &#8211; applicants taking into<br \/>\nconsideration the following aspects:-\n<\/p>\n<p>All<br \/>\n\toffences are Magistrate Triable offences.\n<\/p>\n<p>Accused<br \/>\n\tapplicant no.1 is the driver and accused applicant no.2 is the<br \/>\n\tcleaner.\n<\/p>\n<p>No<br \/>\n\tcriminal history or any past antecedents.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences,<br \/>\nwithout discussing the evidence in detail, at this stage, I am<br \/>\ninclined to enlarge the applicants on bail  in connection with<br \/>\nProhibition C.R.No.5161 of 2011 registered with Amirgadh  Police<br \/>\nStation  for the offences punishable under sections 66(B), 65(A)(E),<br \/>\n81, 116(B), 98 and 99 of Bombay Prohibition Act, on furnishing   bond<br \/>\nof Rs.15,000\/- (Rupees Fifteen thousand only) each with one surety of<br \/>\nthe like amount to the satisfaction of the lower Court and on<br \/>\nconditions that the applicant shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nday of English Calender month between  11.00 a.m. and 2 p.m .\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions Judge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassports, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>In the peculiar<br \/>\nfacts and circumstances of the case, more particularly taking into<br \/>\nconsideration the fact that both the accused are from Hariyana and<br \/>\nthey have been restrained by the order of this Court from leaving the<br \/>\nState of Gujarat till the completion of the Trial.  The Trial Court<br \/>\nis hereby directed to see that no sooner charge-sheet is filed in<br \/>\nconnection with the Prohibition C.R. No.5161 of 2011.  Plea of the<br \/>\naccused applicants is recorded and complete the Trial within a period<br \/>\nof three months without fail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
