Heard Mr. Sajid Salim Khan, learned counsel for the<\/p>\n<p>                  petitioner and Mrs. Indu Bala Pandey, learned Additional Public<\/p>\n<p>                  Prosecutor.\n<\/p>\n<p>                                  The petitioner, who apprehends his arrest in<\/p>\n<p>                  connection with Aurangabad (T) P.S. Case No.290 of 2006<\/p>\n<p>                  registered for the offence under section 409\/34 of the Indian Penal<\/p>\n<p>                  Code, has prayed for grant of anticipatory bail.<\/p>\n<p>                                  It was alleged that the petitioner, who was posted, at<\/p>\n<p>                  the relevant time, as a Divisional Accountant in Road Division No.1,<\/p>\n<p>                  Aurangabad and other officials have not deducted the royalty from<\/p>\n<p>                  the bill to the tune of rupees five lakh and odd. It was alleged that<\/p>\n<p>                  the accused persons had misappropriated the said government<\/p>\n<p>                  money.\n<\/p>\n<p>                                  Learned counsel for the petitioner submits that first<\/p>\n<p>                  information report was lodged long back in the year 2006 and the<\/p>\n<p>                  investigation is still pending, which has not been disputed by learned<\/p>\n<p>                  Additional Public Prosecutor.\n<\/p>\n<p>                                  In view of the fact that investigation is pending since<\/p>\n<p>                  long as well as the fact that the petitioner retired in the month of<\/p>\n<p>                  December, 2009, the court is of the opinion that it is a fit case for<\/p>\n<p>                  extending privilege of anticipatory bail. Let the petitioner, above<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        named, in the event of arrest or surrender before the court below<\/p>\n<p>        within a period of one month from today, be enlarged on bail on<\/p>\n<p>        furnishing bail bond of Rs.10,000\/- with two sureties of the like<\/p>\n<p>        amount each to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>        Aurangabad in connection with Aurangabad (T) P.S.
