Respondents\n                                            -----------\n<\/pre>\n<p>03.   28.03.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                     the counsel appearing for the State.<\/p>\n<p>                             Prayer of the petitioner is for quashing of<\/p>\n<p>                     part of the order of Director of Industry, contained in<\/p>\n<p>                     Memo No. 564, dated 03.03.2003, whereby he has<\/p>\n<p>                     been   shown     as   absorbed    on   the   post    of<\/p>\n<p>                     Correspondence Clerk in stead of the post of Project<\/p>\n<p>                     Manager, though he was working on this post from<\/p>\n<p>                     28.02.1994. Further prayer of the petitioner is for all<\/p>\n<p>                     consequential benefits in case of absorption on the<\/p>\n<p>                     post of Project Manager.\n<\/p>\n<p>                             A detailed Counter Affidavit has been filed<\/p>\n<p>                     on behalf of the State, wherein it has been stated<\/p>\n<p>                     that the petitioner&#8217;s case was considered by the<\/p>\n<p>                     Screening Committee and it was found that the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>      promotion, which was given to the petitioner with<\/p>\n<p>      effect from 01.19.1996 to the post of Project<\/p>\n<p>      Manager was against the present procedure. The<\/p>\n<p>      Screening      Committee        thus      recommended        for<\/p>\n<p>      absorption     of    the     petitioner    to   the   post    of<\/p>\n<p>      Correspondence Clerk on the District Industries<\/p>\n<p>      Centre. The Screening Committee has considered<\/p>\n<p>      the case of the petitioner as per the Bihar Industries<\/p>\n<p>      Service Cadre Rule, 1987.
