Sudha Gautam for the petitioner.\n        Shri Vivek Agrawal, Government Advocate, for the respondents<\/pre>\n<p>on advance notice.\n<\/p>\n<p>        Petitioner is working as Assistant Librarian in the Government<br \/>\nJaywati Hockser Snatkottar College, Betul. By the impugned order-<br \/>\ndated 15.6.2010, she has been transferred to Government Post<br \/>\nGraduate College, Mandla. Interalia contending that transfer in question<br \/>\nis in violation of Clause 9.13 of the transfer policy, his wife is also a<br \/>\ngovernment teacher, she has not been transferred and petitioner alone<br \/>\nis being transferred, challenge is made to the order of transfer.\n<\/p>\n<p>        Having   heard    learned      counsel   for   the   parties   and   on<br \/>\nconsideration of the facts that have come on record, it is clear that the<br \/>\ntransfer in question is challenged only on the ground of violation of<br \/>\ntransfer policy and as the aforesaid grounds are such that they are to<br \/>\nbe considered by the competent authority, it is not appropriate for this<br \/>\nCourt to interfere in the matter.\n<\/p>\n<p>        Accordingly, it is directed that on the petitioner&#8217;s filing certified<br \/>\ncopy of this order alongwith representation within a period of one week,<br \/>\nthe respondents shall consider the representation of the petitioner and<br \/>\ndecide it in accordance with law at an earlier date.\n<\/p>\n<p>        Till the aforesaid exercise is not completed, status quo with<br \/>\nregard to working of the petitioner shall be maintained.\n<\/p>\n<p>        Petition stands disposed of with the aforesaid.<br \/>\n        Certified copy as per rules.\n<\/p>\n<p>                                             (RAJENDRA MENON)<br \/>\n                                                  JUDGE<br \/>\nAks\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Virajvardhan Pandey vs The State Of Madhya Pradesh on 1 July, 2010 01.07.2010.
