3. In brief, the facts of the case are:<\/p>\n

The appellant claims to be aged about 32 years<\/p>\n
and doing business. He was hale and healthy <\/p>\n
the accident. That at about 8.30 p.m., on  .<\/p>\n
appellant was going along with_l1is  fieari “‘<\/p>\n
Gungarabhavi on the extreme left side’ oi’\u00bb.thell’roa.d–,.y at]:<\/p>\n
that time, a bus bearing”lKeg.No.K.1i.17_.A.lf3?”4…..came <\/p>\n
from his behind driven by :yj.t.s:fdrivVer  land
\nnegligent manner  due to
\nwhich, he fell:   of his right
\nclavicle, lgnee,itrighltwclavicle and also
\nsustained”ch.est  he was shifted to
\nNIMI”IAl\\lSl shifted to Tiptur hospital<\/p>\n
for treatment i_?\u00e97he1?einv_he\u00b0yvas treated as inpatient for 44<\/p>\n
 spentlfreasonable amount towards medical<\/p>\n
 ._eXpenses,_conveyance and other incidental charges. On<\/p>\n
acco4unt.oi\u00b0 injuries sustained by the appellant in the<\/p>\n
 accident, he has suffered permanent disability and<\/p>\n
A   has assessed the disability at 25% to the right<\/p>\n
if   ..1_J.,pper limb and at 12% the whole body. Therefore,<\/p>\n
\/<\/p>\n
reasonable compensation towards pain and sufferings and
\ntowards medical expenses and therefore, it does notxcalleyfor<\/p>\n
interference.\n<\/p>\n
6. However, the Tribunal has erred awarding ._ <\/p>\n
reasonable compensation towardsf_loss,_of a1_ne4nit.ie’s.;o_pf ‘life;<\/p>\n
discornforts and unhappiness, and” alsoi.verre’d’ in: <\/p>\n
awarding any compensation  conveyance nourishing
\nfood and attendant   income
\nduring the period of   it needs to be
\nawarded. It  in:i.disp’ute of the injuries
\nsustained    taken treatment as
\n thuereaffter, follow up treatment,
\ndurin\u00e9dthdat have spent considerable amount<\/p>\n
towards co’nveyanVce,A’notirishing food and attendant charges<\/p>\n
   :_-suffered firiancially as he could not attend his work<\/p>\n
“and. i;s_’viewV ‘of the injuries sustained, he has suffered<\/p>\n
‘pern1anentj__ disability and the Doctor has assessed the<\/p>\n
disability at 25% to the right upper limb and 12% to the<\/p>\n
 :whole body, it is permanent in nature and he has to suffer<\/p>\n
Vfthis through out his life. Taking all these factors into<\/p>\n
%\/<\/p>\n

consideration. we award a sum of ?20,000\/– towards
\nconveyance, nourishing food and attendant charges,<\/p>\n
?10,000\/ — towards loss of amenities of life, discomfo.rts,:and<\/p>\n
unhappiness and a sum of ?5,000\/– towards  .<\/p>\n
during the period of treatment.\n<\/p>\n
‘7. For the foregoing reasons,’-._the_p'”impugned’judgine’nt_’<\/p>\n
and award passed by  “Ti’ib1iIA’l{-11′. is to; be <\/p>\n
modified. The total oompens:atio1’i,_\u00bbpayabie comes to
\n?58,000\/–. i<\/p>\n
8. Accordingly,   in part and<\/p>\n
the imvpiuagiiiedxd  and….vaward passed by the
\nTribunal  V \/2003 stands modi\ufb01ed,<\/p>\n
awarding at”aon1pen_sa’tion…of ?35,000\/– with interest at 6%<\/p>\n
 the  the petition till its realisation in<\/p>\n
 ‘adVd’itio11,,tot compensation awarded by the Tribunal.<\/p>\n
