Justice ANTONY DOMINIC\n\n Dated :28\/01\/2011\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                       -------------------------\n                   W.P (C) No.2816 of 2011\n                      --------------------------\n              Dated this the 28th January, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner claims to be the owner of four canoes<\/p>\n<p>bearing    registration Nos.5308 KQN, 5608 KQN, 5763<\/p>\n<p>KQN and 5764 KQN. It is stated that the canoes were<\/p>\n<p>seized by the 1st respondent on the allegation that the<\/p>\n<p>same were used in violation of the provisions contained in<\/p>\n<p>Kerala   Protection   of   River     Banks     (Protection and<\/p>\n<p>Regulation of removal of sand) Act, 2002. According to the<\/p>\n<p>petitioner, the 1st respondent ought to have released the<\/p>\n<p>canoes. But however, the canoes have not been released.<\/p>\n<p>It is in these circumstances, the writ petition has been<\/p>\n<p>filed.\n<\/p>\n<p>      2.    Evidently, canoes have been seized on the<\/p>\n<p>allegation that the same were        used in violation of the<\/p>\n<p>principles contained in     the Kerala Protection of River<\/p>\n<p>Banks (Protection and Regulation of removal of sand) Act,<\/p>\n<p>2002.     Such proceedings should pending before the 2nd<\/p>\n<p>respondent, the authority competent under the Act.<\/p>\n<p>Therefore, if the petitioner want either interim custody of<\/p>\n<p>W.P (C) No.2816 of   2011<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>the canoes or finalisation of the proceedings, petitioner<\/p>\n<p>would have to approach the 2nd respondent and seek<\/p>\n<p>appropriate reliefs.\n<\/p>\n<p>      3.
