MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\napplication has been preferred for condoning the delay of 316 days in<br \/>\npreferring appeal against order dated 6th<br \/>\nMay 2009 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.4371 of 2009.\n<\/p>\n<p>\tThe<br \/>\napplicant has shown the detailed ground for delay in preferring the<br \/>\nappeal.   We find that permission was sought for from the office of<br \/>\nthe Mamlatdar &amp; ALT, Choryasi up to the higher level and then<br \/>\nafter order passed by the Under Secretary, Legal<br \/>\nDepartment<br \/>\non 22nd<br \/>\nDecember 2009 to Collector, Surat was asked to prefer appeal.<br \/>\nThereafter, the matter took some time in the office of the learned<br \/>\ncounsel for the State to prefer the appeal.  In spite of notice, the<br \/>\nrespondents have not filed any petition for opposing the prayer.<br \/>\nTaking into consideration the facts of the case and being satisfied<br \/>\nwith<br \/>\nthe ground shown, delay of 316 days in preferring the appeal is<br \/>\ncondoned.
