HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                         B.A. No. 6377 of 2008\n         - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 16th day of October,2008\n\n                                  O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>       2. The alleged offences are under sections 143, 147, 148,<\/p>\n<p>452, 427, 308, 506(ii) read with section 149 IPC.                   According to<\/p>\n<p>prosecution, petitioner along with 14 others formed themselves<\/p>\n<p>into an unlawful assembly and attacked the house of defacto-<\/p>\n<p>complainant and also defacto-complainant by throwing bomb,<\/p>\n<p>etc. The incident occurred on 25-8-2008.<\/p>\n<p>       3. Petitioner is the 5th accused and he was arrested on the<\/p>\n<p>same day on 25-8-2008 and he is in custody since then. Learned<\/p>\n<p>Public Prosecutor submitted that the case is an off-shoot of<\/p>\n<p>political rivalry between N.D.F. and C.P.I.(M) workers. De facto<\/p>\n<p>complainant is a C.P.I.(M) worker. Tension is prevalent in the<\/p>\n<p>locality and hence stringent condition may be imposed, though<\/p>\n<p>he has no objection in granting bail.\n<\/p>\n<p>       4. Hence, petitioner shall be released on bail on his<\/p>\n<p>executing a bond for Rs.25,000\/- with two solvent sureties each<\/p>\n<p>for the like amount to the satisfaction of the learned Magistrate,<\/p>\n<p>on the following conditions:-\n<\/p>\n<p>              1)     Petitioner       shall     report      before       the<\/p>\n<p>                     Superintendent of Police, Kannur on every<\/p>\n<p>BA 6377\/08                        -2-\n<\/p>\n<blockquote><p>                 alternate day between 10 a.m. and 1 p.m.<\/p>\n<p>                 until further orders.\n<\/p><\/blockquote>\n<blockquote><p>           2)    Petitioner shall not enter the limits of the<\/p>\n<p>                 police station within which the crime is<\/p>\n<p>                 registered except with the prior permission<\/p>\n<p>                 of the learned Magistrate.<\/p>\n<\/blockquote>\n<blockquote><p>           3)    Petitioner  shall  not  intimidate  or<\/p>\n<p>                 influence any witness or tamper with<\/p>\n<p>                 evidence     or commit any offence<\/p>\n<p>                 while on bail and in case breach of<\/p>\n<p>                 this condition, bail is liable to be<\/p>\n<p>                 cancelled.\n<\/p><\/blockquote>\n<blockquote><p>      This petition is allowed.<\/p>\n<\/blockquote>\n<blockquote><p>                                           K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Poyilan Sadiqe vs The Station House Officer on 16 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6377 of 2008() 1.
