     The Panchayat has come up in appeal against the<\/p>\n
award of enhanced compensation for the buildings which<\/p>\n
existed on the property under acquisition. The claimant has<\/p>\n
filed a memorandum of cross objection contending that the<\/p>\n
compensation awarded by the reference court is not<\/p>\n
adequate.     The land acquisition officer awarded a total<\/p>\n
amount of Rs.1,23,370\/- obviously adopting               the PWD<\/p>\n
schedule of rates for valuation. Before the reference court<\/p>\n
the cross objector claimant took out a commission.            The<\/p>\n
commissioner was assisted by a Chartered Engineer and<\/p>\n
approved valuer.         He submitted Ext.A1(b) valuation<\/p>\n
statement which was accepted by the Commissioner and<\/p>\n
produced along with the commissioner’s report.              As per<\/p>\n
Ext.A1(b) a total amount of Rs.4,10,000\/- is recommended<\/p>\n
LAA.405\/09 & CO. 43\/09\n<\/p>\n

\nas the value of the buildings. Before the reference court the<\/p>\n
Chartered Engineer was examined as AW2 and the<\/p>\n
Commissioner’s report was marked as Ext.C1.        The court<\/p>\n
below was not inspired by A1(b) valuation report or by the<\/p>\n
testimony of AW2. The court below however, noticed that in<\/p>\n
A1(b) report no depreciation had been made.        However,<\/p>\n
taking into account the fact that the two shop rooms which<\/p>\n
accounted for substantial portion of the buildings were<\/p>\n
constructed just one year earlier, the court below would<\/p>\n
obviously on the basis of guess work fix value of the<\/p>\n
building at Rs.2,50,000\/-. In the appeal preferred by the<\/p>\n
Panchayat they assail such fixation as excessive and<\/p>\n
arbitrary.    In the memorandum of cross objection the<\/p>\n
claimant contends that Ext.A1(b) valuation report should<\/p>\n
have been accepted and the full value recommended in A1<\/p>\n
(b) that is, Rs.4,10,000\/- should have been awarded.<\/p>\n
Sri.T.H.Abdul Azeez, learned counsel for the appellant would<\/p>\n
LAA.405\/09 & CO. 43\/09\n<\/p>\n

\nargue on the basis of Ext.C1 report and A1(b) valuation<\/p>\n
statement that atleast the sum of Rs.4,10,000\/- should have<\/p>\n
been awarded.\n<\/p>\n
     2. We have considered the rival submissions. We have<\/p>\n
gone through Exts.C1 and A1(b). We are in agreement with<\/p>\n
the learned Subordinate Judge that A1(b) valuation report is<\/p>\n
not a convincing one. We notice from A1(b) that what the<\/p>\n
Engineer has done is to value the building not on the basis<\/p>\n
of the measurements and other details recorded during<\/p>\n
inspection, but to calculate the total cost on the basis that<\/p>\n
the construction cost is Rs.7000\/- per sq. metre. We are<\/p>\n
also therefore not impressed much by A1(b) report in terms<\/p>\n
of which only AW2 has given his evidence. At the same<\/p>\n
time, we feel that there was justification for awarding<\/p>\n
enhancement of compensation for the building since<\/p>\n
obviously the L.A. Officer valued the building on the basis of<\/p>\n
the PWD schedule rates.        We notice that the PWD is<\/p>\n
LAA.405\/09 & CO. 43\/09\n<\/p>\n

\ntendering its civil works at rates higher than their published<\/p>\n
rates. We also notice that the shop rooms in question were<\/p>\n
relatively   new      constructions.     Taking   both    those<\/p>\n
circumstances into account, we modify the judgment and<\/p>\n
decree of the learned Subordinate Judge to the extent the<\/p>\n
same pertains to value of the buildings and refix the value<\/p>\n
of the building at Rs.2 lakhs.\n<\/p>\n
       Appeal stands allowed as above. Cross objection<\/p>\n
stands dismissed.      Needless to mention that the claimant<\/p>\n
cross objector will be entitled to all statutory benefits on the<\/p>\n
enhancement as refixed under this judgment.<\/p>\n
