SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 17\/10\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\tThough<br \/>\nonly Civil Application was listed on Board today, with the consent of<br \/>\nthe parties, we have taken the Letters Patent Appeal itself for final<br \/>\ndisposal.\n<\/p>\n<p>1.\tThis<br \/>\nLetters Patent Appeal has been filed challenging the order dated<br \/>\n23.08.2011 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.6023\/2011.\n<\/p>\n<p>2.\tWe<br \/>\nhave heard learned counsel for the parties. It appears that the<br \/>\nrespondent-authority has passed the impugned order of recovery,<br \/>\nwithout issuing any Notice to the appellants. Mr. NJ Shah learned AGP<br \/>\nis not in a position to show from the record that any Notice was<br \/>\nissued to the appellants before the order of recovery was passed.<br \/>\nHence, we are of the opinion that only on the ground of non-issuance<br \/>\nof notice, the impugned order of recovery deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, the appeal is allowed and the order dated<br \/>\n23.08.2011 passed by the learned Single Judge is quashed and set<br \/>\naside. It shall, however, be open to the respondent-authority to pass<br \/>\nfresh order of recovery, after issuing Notice to the appellants. The<br \/>\nappeal stands disposed of accordingly as allowed.\n<\/p>\n<p>4.\tSince<br \/>\nthe main appeal has been allowed, the civil application stands<br \/>\ndisposed of.
