Ad-interim stay of operation, execution and<br \/>\nimplementation of the Award on condition that the applicant-appellant<br \/>\ndeposits the awarded amount, with costs and interest, with the<br \/>\nTribunal within four weeks from today, till then.&#8221;\n<\/p>\n<p>Today,<br \/>\n\tMr. G.P. Baghel, learned counsel appearing for the original<br \/>\n\tclaimants submits that the amount has been deposited in part, but<br \/>\n\tfull amount has not been deposited. Mr. Thomas for Mr. Nanavati for<br \/>\n\tthe applicant states that the remaining amount, if any, shall be<br \/>\n\tdeposited within four weeks from today. Under the above<br \/>\n\tcircumstances, ad interim relief granted earlier shall stand<br \/>\n\tconfirmed on condition that the remaining amount  shall also be<br \/>\n\tdeposited within four weeks from today.\n<\/p>\n<p>We<br \/>\n\thave heard Mr. Thomas for Mr. Nanavati for the applicant and Mr.<br \/>\n\tBaghel for the  original claimants on the aspect of  withdrawal.<br \/>\n\tPresence of the other parties to the proceedings may not be required<br \/>\n\tat this stage.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, out of the total awarded amount of Rs.<br \/>\n\t9,51,688\/- with interest and cost, admitted liability is of Rs.<br \/>\n\t4,09,160\/- with the proportionate interest and cost and, therefore,<br \/>\n\tthe Tribunal shall bifurcate the amount into two parts; one would be<br \/>\n\t the amount of Rs.4,09,160\/- with the proportionate interest and<br \/>\n\tcost as admitted liability and the said amount shall be appropriated<br \/>\n\tby the Tribunal as per the judgment and award of the Tribunal for<br \/>\n\tthe purpose of withdrawal and investment. Remaining amount of Rs.<br \/>\n\t5,42,528\/- with the proportionate interest and cost shall be<br \/>\n\tinvested by the Tribunal in a Fixed Deposit Receipt initially for a<br \/>\n\tperiod of three years and such investment shall be renewed from time<br \/>\n\tto time until the appeal is finally heard and disposed of. But the<br \/>\n\toriginal claimant shall be entitled to periodical interest as and<br \/>\n\twhen it becomes due.\n<\/p>\n<p>The<br \/>\n\tapplication is allowed to the aforesaid extent.
