Justice M.SASIDHARAN NAMBIAR\n\n Dated :11\/07\/2008\n\n O R D E R\n                  M.SASIDHARAN NAMBIAR, J.\n                    ...........................................\n                  WP(C).No. 20468                 OF 2008\n                   ............................................\n         DATED THIS THE            11th        DAY OF JULY, 2008\n\n                               JUDGMENT\n<\/pre>\n<p>      This petition is filed under Article 227 of Constitution of<\/p>\n<p>India for a direction to Sub Judge, Kozhikode to expedite the<\/p>\n<p>passing of the orders in I.A.2295 of 2001 in O.P.9 of 2004 and<\/p>\n<p>Arbitration O.P 6 of 2001.\n<\/p>\n<p>      2.    Learned counsel appearing for petitioner and third<\/p>\n<p>respondent were heard. The learned counsel appearing for<\/p>\n<p>petitioner submitted that the case was heard by learned Sub<\/p>\n<p>Judge in 2003 itself and Ext.P3 argument notes were submitted<\/p>\n<p>in the court in April 2003 and still the orders are not being<\/p>\n<p>passed.    The registry was          directed to contact the Presiding<\/p>\n<p>Officer and it was reported that the matter was heard originally<\/p>\n<p>and posted for orders to 15.2.2008, on 1.2.2008 and now stands<\/p>\n<p>posted to 11.7.2008. Learned Sub Judge heard the matter on<\/p>\n<p>1.2.2008 and even if some clarification is necessary, that<\/p>\n<p>clarification should have been heard and orders should have<\/p>\n<p>been passed without further delay. It is unfortunate that the<\/p>\n<p>matter still remains with learned Sub Judge.
