Gupta\n\nHon'ble Satya Poot Mehrotra,J.\n<\/pre>\n<p>Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p>Order On<\/p>\n<p>Civil Misc.Restoration Application No. 310543 of 2009<\/p>\n<p>  By the order dated 10.11.2009, the appeal was dismissed for<br \/>\nwant of prosecution. It was further observed that interim order, if<br \/>\nany, stood vacated.\n<\/p>\n<p>   The aforementioned application has been filed, inter-alia,<br \/>\npraying for recall of the said order dated 10.11.2009 dismissing the<br \/>\nappeal for want of prosecution and for restoring the appeal to its<br \/>\noriginal number. The application is supported by an affidavit,<br \/>\nsworn by Ashok Singh, stated to be the Registered Clerk to the<br \/>\nlearned counsel for the claimant-appellant.\n<\/p>\n<p>  It is ,inter-alia, stated in the said affidavit that due to inadvertent<br \/>\nmistake, the said Ashok Singh could not mark the case in the Daily<br \/>\nCause List, and in the circumstances, the learned counsel for the<br \/>\nclaimant-appellant ( Sri Kunwar Siddharth Singh) could not appear<br \/>\nbefore the Court when the case was taken up on 10.11.2009, and<br \/>\nconsequently, the case was dismissed for want of prosecution.\n<\/p>\n<p>  Copy of the aforementioned application has been served on Sri<br \/>\nP.K.Mukerjee, learned counsel for respondent no.1.\n<\/p>\n<p>  We have heard Sri Kunwar Siddharth Singh, learned counsel for<br \/>\nthe claimant-appellant and Sri P.K.Sinha holding brief for Sri<br \/>\nP.K.Mukerji, learned counsel for respondent no.1, and perused the<br \/>\naforementioned application and its supporting affidavit.\n<\/p>\n<p>  Having regard to the averments made in the aforementioned<br \/>\napplication and its supporting affidavit and having considered the<br \/>\nsubmissions made by the learned counsel for the parties, we are<br \/>\nsatisfied that sufficient cause has been made out for absence on<br \/>\nbehalf of the claimant-appellant when the case was taken up before<br \/>\n the Court on 10.11.2009 and was dismissed for want of<br \/>\nprosecution.\n<\/p>\n<p> In view of the above, the aforementioned application is allowed.<br \/>\nThe order dated 10.11.2009 dismissing the appeal for want of<br \/>\nprosecution is recalled. The appeal is restored to its original<br \/>\nnumber.\n<\/p>\n<p> The appeal will now be listed before the appropriate Bench.
