Justice P.BHAVADASAN\n\n Dated :12\/02\/2009\n\n O R D E R\n             J.B.KOSHY, Ag.CJ &amp; P.BHAVADASAN, J.\n                 ===========================\n                    W.A.No.568 of 2006 - B\n               ===============================\n           Dated this the 12th day of February, 2009.\n\n                        J U D G M E N T\n<\/pre>\n<p>Koshy, Ag.CJ.\n<\/p>\n<p>     Action was taken to recover amounts from the appellant&#8217;s<\/p>\n<p>establishment under the Provident Fund Act with effect from<\/p>\n<p>31.5.1988.     Appellant is a registered society under the<\/p>\n<p>Travancore-Cochin Literary, Scientific and Charitable Societies<\/p>\n<p>Act, 1955.   It was running three schools in the same premises.<\/p>\n<p>One is a residential school called St.John&#8217;s Residential School<\/p>\n<p>with CBSE syllabus. The other is St.John&#8217;s High School with KER<\/p>\n<p>syllabus. The third school is under ICSC syllabus. Steps were<\/p>\n<p>taken to combine the schools as one establishemnt under the<\/p>\n<p>Employees Provident Fund Act.     Even though the matter was<\/p>\n<p>contended up to the Tribunal level, their contention was not<\/p>\n<p>accepted.   Three schools were clubbed and contributions were<\/p>\n<p>demanded. Counsel for the appellant contends that all the three<\/p>\n<p>schools have got different Headmasters. Administration of the<\/p>\n<p>schools is done by Headmasters and not by the society and three<\/p>\n<p>W.A.No.568 of 2006 &#8211; B<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>schools have different accounts and different syllabuses. Rules to<\/p>\n<p>be obeyed by the schools are also different. On the contrary,<\/p>\n<p>contention of the respondent is that the management was the<\/p>\n<p>same even though the accounts are separately maintained.<\/p>\n<p>Accounts were also found combined and its managed from the<\/p>\n<p>same office. Financial control also rests with the management.<\/p>\n<p>Even though three separate syllabuses were there, facility like<\/p>\n<p>school bus, boarding, grounds etc. are common. Taking these<\/p>\n<p>aspects, there is functional integrality with these three schools.<\/p>\n<p>Common non-teaching staff are also employed.           They were<\/p>\n<p>unaided institutions.    The emblem, uniform etc. are also<\/p>\n<p>common.     Considering all these facts, Tribunal as well as the<\/p>\n<p>learned Single Judge found that there is functional integrality and<\/p>\n<p>establishment is liable to be covered under the Employees<\/p>\n<p>Provident Fund Act. But learned Single Judge directed to deposit<\/p>\n<p>contribution only from February, 1991 for valid reasons. Learned<\/p>\n<p>counsel for the appellant submits that now even as separate<\/p>\n<p>establishment each school is liable to be covered as all these<\/p>\n<p>three schools employees may not have 20 staff members. Staff<\/p>\n<p>W.A.No.568 of 2006 &#8211; B<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>strength of each school as on February, 1991 is also not<\/p>\n<p>produced by the appellant.   In these circumstances, we see no<\/p>\n<p>ground to interfere in the finding of fact entered by the<\/p>\n<p>authorities as confirmed by the learned Single Judge.
